US Hwy #1 8 SITUATE IN ST. LUCIE COUNTY, FLORIDA 9 10 11 12 13 14 15 16 17 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: Fine Realtv. Corn. petitioned for a variance from the provisions of Section 7.10.16(E) of the St. Lucie County Land Development Code at 2601 N. US Hwy # 1 to reduce the required lot size from 70 feet by 40 feet down to 60 feet by 30 feet for the development of a recreational vehicle park known as Harbor Town RV 8~ Resort. 2. On October 24, 2012, this Board held a public hearing on the petition, after publishing a notice of such hearing in the newspaper, installing a sign on the property and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The requested variance has met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code, and is not in conflict with the goa/s, objectives, and policies of the St. Lucie County Comprehensive Plan, because: A. The granting of the requested variance would not impair or otherwise injure adjacent property owners or improvements in the area in which the subject property is located,~ 8. The granting of the requested variance allows for the required Major Site Plan (which requires Board of County Commission approval), to be designed reflecting the reduced lot size from 70 feet by 40 feet down to 60 feet by 30 feet for the development of a recreational vehicle park known as Harbor Town RV 8 Resort. C. The requested variance meets the general spirit and intent of the St. Lucie County Land Development Code and the St. Lucie County Comprehensive Plan. JOSEPH E. SMITH. The petition of Fein Realty Corp. for a variance from the provisions of Section 7.10.16(E) of the St. Lucie County Land Development Code at 2601 N. US Hwy # 1 to reduce the required lot size from 70 feet by 40 feet down to 60 feet by 30 feet for the development known as Harbor Town RV & Resort in the Recreational Vehicle Park (RVP) Zoning District is hereby granted based on the evidence, for the property depicted on the attached map as Exhibit "A" and described as follows: LEGAL DESCRIPTION: All that part of the North 358.8 feet of the South 1735.9 feet of the NE 1/4 lying West of U.S. Highway No. 1, Section 33, Township 34 South, Range 40 East, St. Lucie County, Florida. AND Begin at the Southwest corner of the portion of the North 365.8 feet of the South 1377.1 feet of the Northeast quarter of Section 33, Township 34, South, Range 40 East, lying West of U.S. Highway No. 1, St. Lucie County, Florida. From the point of beginning run North along the center line of Section 33 a distance of 365.8 feet to a point; thence run East along the North line of the North 365.8 feet of the South 1377.1 feet of the Northeast quarter of Section 33, Township 34 South, Range 40 East, a distance of 400 feet to a point; thence run South a distance of 200 feet to a point; thence run Southeasterly a distance of 193.77 feet to a point on the South line of the North 365.8 feet of the South 1377.1 feet of the Northeast quarter of Section 33, Township 34 South, Range 40 East, which point is 483 feet East of the point of beginning and 200.29 feet West of the West right of way line of new U.S. Highway No. 1; thence run West along the South line of the North 365.8 feet of the South 1377.1 feet of the Northeast quarter of Section 33, Township 34 South, Range 40 East, to the point of beginning. Subject to easements, restrictions and reservations of record and taxes for the year 2007 and thereafter. An appeal of the Board of AdjustmenYs action may be processed in accordance with Section 10.01.07 of the St. Lucie County Land Development Code. C.
