FIRST AMENDMENT TO DEVELOPMENT AGREEMENT C09-02-164 BETWEEN BOARD OF COUNTY
COMMISSIONERS OF SAINT LUCIE COUN'{~`/ FLORIDA AND LENNAR HOMES, LLC
This First Amendment dated the ~day of ~~~ +~!r~~ 2012 to that certain Development
Agreement by and between Saint lucie County, a political subdivision of the state of F{orida {the Board~
and Lennar Homes, LlC ( the Developer }is hereby amended as follows:
1. FVP Miami Lakes, LLC, is hereby substituted for Lennar Homes, LLC in the opening paragraph
of the Agreement.
2. FVP Miami Lakes, LLC, is the owner of legal and equitable title to the property described in
exhibit A of the Agreement.
3. Section 3 of the Agreement is hereby amended as follows:
The duration of the Agreement shall be extended for an additional five years commencing
upon the effective date of this First Amendment. The time for deveiopment set forth in the site plan
approval, as we11 as phasing and timeframe for construction under the development schedule contained
in exhibit C of said Agreement, and the expiration of that certain certificate of capacity number 2071,
dated August 5 2005, sfiaH be extended commensurate with the extension of this Amendment, such that
the time for development as eutended by this Amendment shall supersede any time frames set forth in
said site pfan approval and certificate of capacity including the expiration dates included therein.
4. This First Amendment shall be effective upon recording in the Public Records of St. Lucie
County, Florida. The First Amendment shalf be recorded by the Developer within fourteen (14) days
after the Soard approves the First Amendment.
5. Section 11(c) of the Agreement is hereby amended as follows:

6. Except it as amended herein, the remaining terms and conditions of the Development
Agreement shall remain in full force and effect.
In witness whereof, the parties have caused the execution of this Amendment by their duly
