HomeMy WebLinkAboutPDS-12-038 - Lot Split Approval Orange Avenue1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 PDS NO. 12-038 File No. LS 1120124572 AN ORDER GRANTING A LOT SPLIT APPROVAL FOR PROPERTY CONSISTING OF 235.05 ACRES LOCATED ON ORANGE AVENUE WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Lot Split approval submitted by Laventure & Associates, Inc. on behalf of Eduardo Leal and made the following determinations: 1. Leal &Secada, LLC petitioned for a lot split approval for property consisting of 235.05 acres of property in the AG-5 (Agricultural -5) Zoning District, located on the north side of Orange Avenue at the northwest corner of Knight Road and Orange Avenue, as described in Part B below. 2. The division of the parent tract results in the creation of two lots to be known as Parcel 1-A consisting of 155.10 acres and Parcel 1-B consisting of 79.95 acres. 3. The Planning & Development Services staff has reviewed the lot split on the subject property and found it to meet technical requirements of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Pan. 4. The lot split will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code provides that no further division of an approved lot split is permitted unless a final record plat is prepared and approved in accordance with the Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Leal & Secada, LLC Lot Split is hereby approved as shown on the boundary survey prepared by Richard C. Laventure, dated October 26, 2012, subject to the following condition: 1. Condition of approval is that Parcel 1-B and Parcel II (Property Tax ID#2210-111- 0003-000/3) as described on the boundary survey shall be joined by a Unity of Title. 2. Prior to issuance of a Vegetation Removal Permit or Exemption, and/or Building Permit the recorded warranty deeds reflecting final division of the property with the legal descriptions for each new parcel shall be provided to the Planning and Development Services Department. The property on which this Lot Split approval is being granted is described as follows: THE WEST 'h OF THE NE'/a AND ALL OF THE NW'/a OF SECTION 10, TOWNSHIP 35 SOUTH, RANGE 38 EAST, ST. LUCIE COUNTY, FLORIDA. LESS AND EXCEPTING THEREFROM RIGHTS OF WAY FOR ROADS AND CANALS. PARCEL ID# 2210-112-0001-000/2 C. The approvals granted by this administrative order shall expire November 30, 2013. D. The Lot Split approval granted under this Order is specifically conditioned to the requirement that the property owners, successors and assigns in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, North St. Lucie Water Control District and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the Planning and Development Services Department within 30 days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the Boundary Survey drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning and Development Services Director. G. The conditions set forth in Part A are an integral nonseverable part of the lot split approval granted by this Order. If any condition set forth is Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the approval granted by this order shall become null and void. H. This order shall be recorded in the Public Records of St. Lucie County.
