LUCIE COUNTY 6LADE5 ROAD LANDFILL; REDUCIN6 THE RATES FOR DISPOSAL OF CLA55 III WASTE; ESTABLISHIN6 A BALIN6 AND HANDLIN6 FEE FOR RECYCLABLE MATERIAl.S DELIVERED BY THE COUNTY'S FRANCHISE HAVLER; ESTABLISHIN6 RESTRI~ i iONS ON THE USE OF THE COUNTY'S FACILITIES; REPEALIN6 AND SUPERSEDIN6 RESOLUTION NO. 12-125; AND PROVI~IN6 AN EFFECTIVE DATE WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, (the "BoQrd"), has made the following determinations: 1. The County owns and operates a solid waste management fncility ("Fncility") located at 6120 6lades Cut-Off Road in the City of Fort Pierce, Florida. The County's Fncility includes a Class I Iandfill, Q disposal area for construction and demolition debris, a recycling center, and related facilities that are used for the processing, recycling, and disposing of various types of solid waste. 2. On June 19, 2012, the County adopted Resolution No. 12-125 that established the "tipping fees" (i.e. rates) the County will charge for the processing and disposal of solid wuste at the County's Fncility. The County now wishes to reduce the tipping fees that the County will charge for processing Class III waste that is delivered to the Facility. The County also wishes to establish a baling and handling fee for recyclable materials delivered by the County's exclusive hauler. Accordingly, the new tipping fees for these materials, as well as the current tipping fees for other materials, are set forth in Sections A and B below. 3. The tipping fees established in Sections A and B below, are rensonable nnd appropriate-i.e., the rates fairly compensate the County for the services it provides when processing solid wnste and recyclable materials at the County's Facility. The limitations set forth herein concerning the use of the County's Facility are in the best interest of the public and they are necessary for the protection of the public heQlth, safety, and welfare. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida, that the following tipping fees for use of the County's Facility, and the following limitations on the use of the County's Facility are hereby approved and adopted: SE~ i iON A : 1. Minimum fees for disposal of all solid waste. a. Automobiles and utility vehicles: Regular fee $2.50 per lond Uncovered $5.00 per load b. Vans, trucks, including open bed pick-up trucks, trailers: Regular fee $4.50 per load Uncovered fee $9.00 per load 2. Tonnage rates, applicnble to all loads in excess of the minimums set forth in paragraph 1. a. Clnss I waste - all solid wuste, except: yard waste, construction nnd demolition debris, septage, white goods, hazardous waste, tires, special waste and any solid waste that cannot be disposed of in the County's Landfill under an applicable federal, state or local regulation: Regular fee $41.00 per ton Uncovered fee $82.00 per ton b. Whole tires: Minimum fee $0.80 per automobile tires smaller than 20" rim size for disposnl of up to 5 automobile tires Tonnage rates, applicable for disposal of more than 5 automobile tires (less than 20" rim size): Regular fee $ 85.00 per ton Uncovered fee $170.00 per ton e. Shredded or snlit tires: Regular fee $ 51.00 per ton Uncovered fee $102.00 per ton f. Larae tires: all tires 20" rim size and larger including f loat tires, truck tires and off-road tires: Regular fee $300.00 per ton (No cover required) g. White aoods and other abbliances: Secured fee $2.50 per lond Unsecured fee $5.00 per load h. Clenn Wood: Regu lar f ee $15.00 per ton Uncovered fee $30.00 per ton NOTE: Pressure treated wood and painted wood must be handled as Class I waste. i. Specia~ Wastes - wastes requiring special handling including but not limited to ashes, nsbestos, nnd contaminated soils: Regular fee $ 70.00 per ton Uncovered fee $140.00 per ton A minimum one ton fee will be charged for the disposal of all special wastes. 4. Spent fluorescent light bulbs: $.20 per bulb for St. Lucie County businesses $.40 per bulb for non-county businesses 5. Fees for weighing trucks at the Facility's scnle house. Misc. Weight determination: $2.50 per weighing 6. Out of County Waste: The disposal of solid waste generated outside of St. Lucie County must be approved by the Solid Waste Director or his designee. SECTION B. Municipalities and npproved operators shall pay the fees specified in Section A of this Resolution on n monthly basis, following their receipt of the County's bill for the use of the County's solid waste management fncility. SECTION C. All other users of the County's solid wuste manngement facilities shall pny the fees specified in Section A of this Resolution when they deliver their solid waste or recyclnble materials to the St. Lucie County Landfill, unless the user has entered into a Landfill Use Agreement with the County and posted the required security. SECTION D. Effective March 1, 2013, this Resolution shall repeal, supersede, and replace Resolution No. 12-125. SECTION E. All of the rates set out in this Resolution shall take effect on March 1, 2013.
