HomeMy WebLinkAboutPDS-13-005 - Variance at 1075 Nettles Blvd.,> 2 3 4 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 PDS ORDER 13-005 File No. AV 220134594 AN ORDER GRANTING APPROVAL FOR AN ADMINISTRATIVE VARIANCE FOR CERTAIN PROPERTY LOCATED AT 1075 NETTLES BLVD., JENSEN BEACH, FLORIDA WHEREAS, the Planning and Development Services Director has reviewed the application for an administrative variance including but not limited to the staff report and made the following determinations: Petition of John & Sharon Prisk for an administrative variance from the provisions of Section 7.10.16(Q1.a.1) of the St. Lucie County Land Development Code to allow for the construction of handicap ramp with a lift which will encroach a maximum of four feet into the minimum side setback of eight feet located at 1075 Nettles Blvd, in the HIRD (Hutchinson Island Residential District) Zoning. 2. The Zoning Division has reviewed and commented on the proposed variance request and found it to meet technical requirements of the St. Lucie County Land Development Code. 3. After consideration of the exhibits, including staff comments, and the standards of review for granting variances set out in Section 10.01.14, St. Lucie County Land Development Code, the Planning and Development Services Director has made the following determinations: The requested administrative variance has met the standards of review as set forth in Section 10.01.14, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because A. Nettles Island, Inc. has been in existence since July 22, 1970 8. The placement of the proposed structure will meet the intent of all separation standards as required for all Recreational Vehicle Parks. C. The granting of the requested variance would not impair or otherwise injure other property or improvements in the area in which the subject property is located. D. The literal application of the provisions of Section 7.10.16(Q) will result in an o undo hardship on the property owners and would otherwise prohibit the use ~ of the petitioned property as others are used in the surrounding neighborhood ~ o U E. The variance requested will not result in any encroachment into any W access/utility easement or other common area. ~ a o o ~ `° F. Petition of John & Sharon Prisk for an administrative variance from the provisions of Section 7.10.16(Q)(a.1) of the St. Lucie County Land Development Code to allow for the construction of a handicap ramp and lift which will encroach a maximum of four feet into the minimum side setback of eight feet located at 1075 Nettles Island, Jensen Beach, Florida in the HIRD (Hutchinson Island Residential District) Zoning, for the property depicted on the attached map as Exhibit "A" and described as follows: LEGAL DESCRIPTION: NETTLES ISLAND INC., ACONDO -SECTION II PARCEL 1075N AND PRO-RATA SHARE IN COMMON ELEMENTS Property Tax ID#4502-501-1262-000-2 B. Based on the evidence presented, this administrative variance request is approved. C. This variance shall expire twelve months from the date of adoption unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code.
