AN ORDER GRANTING APPROVAL FOR A MINOR
ADJUSTMENT TO MAJOR SITE PLAN KNOWN AS
ST. LUCIE COUNTY SHERIFF'S DEPARTMENT
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the application for Minor Adjustment approval submitted by Stephen Cooper, P.E. & Associates,
Inc. on behalf of St. Lucie County Sheriff's Department, and the comments of the St. Lucie
County Development Review Committee on this application and made the following
determinations:
1. St. Lucie County Sheriff's Department presented a petition for a Minor Adjustment to a
Major Site Plan known as St. Lucie County Sheriff's Department to allow for the
construction of a 27,027 square foot covered structure over the existing designated
vehicular storage compound and a 882 square foot covered overhang addition to the
existing administration and operations building on 10 acres of property located at 4700
W. Midway Road in the I (Institutional) Zoning District, as described in Part B below.
2. The Development Review Committee has reviewed the site plan adjustment for the
proposed project and found it to meet technical requirements of the St. Lucie County
Land Development Code and to be consistent with the St. Lucie County Comprehensive
Pan, subject to the conditions set forth in Part A of this Order.
3. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
4. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
5. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with St. Lucie
County Land Development Code requirements.
6. The proposed project is to be served by Fort Pierce Utilities Authority water and
WaSteWater S2rVIC2S.
NOW, THEREFORE, BE IT ORDERED:

A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the
Minor Adjustment to the St. Luce County Sheriff's Department Major Site Plan is hereby
approved as shown on the site plan drawings for the project prepared by Stephen
Cooper, P.E. & Associates, Inc., dated June 3, 2013 and date stamped received by the
St. Lucie County Planning and Development Services Department on June 3, 2013,
subject to the following conditions:

The applicant shall execute an agreement to pay afee-in-lieu of the construction for
sidewalk and remit to the County the required funds within 90 days after receiving
final site plan approval. The acceptable method of payment shall be a certified
check payable to St. Lucie County. A copy of the standard "Agreement" can be
obtained by visiting the St. Lucie County Public Works Department website at
http://www.stlucieco.gov/public_works /index.htm.
2. The County's issuance of development approval does not constitute compliance with
any federal and state requirements. Applicable, federal and state approvals/permits
are required prior to the commencement of any development activity (i.e. clearing,
grading, removing structures, etc.). The responsibility for contacting federal and
state agencies, procuring permits/approvals and compliance with applicable laws are
the sole responsibility of the applicant.
3. Per Florida Statute 125.022, the issuance of development approval does not create
any liability on the part of the county if the applicant fails to obtain requisite approvals
or fulfill the obligations imposed by a state or federal agency or undertakes actions
that result in a violation of state or federal law.
4. Copies of all applicable state or federal permits/written approvals are required by the
County prior to issuance of a Vegetation Removal Permit and any development
activity.
B. The property on which this site plan approval is being granted is described as follows:
BEING the West 744.61 feet of the East 2565.00 feet (as measured at right angles from the East
line of the North'/z of Section 6, Township 36 South, Range 40 East, St. Lucie County, Florida) of
the North 585.00 feet of the South 625 feet (as measured at right angles from the Centerline of
Midway Road as per Florida Department of Transportation Right-of-Way Map Section No. 94530-
2602, Sheets 6 and 7 of 7) of that part of Lots 9, 10 and 11 of the Northeast '/a of Model Land
Company Subdivision according to the Plat thereof recorded in Plat Book 4, at Page 34 of the
Public Records of St. Lucie County, Florida, lying North of Midway Road right-of-way as per said
right-of-way map and containing 10.00 Acres (43560.00 Square Feet), more or less.

C. The approvals granted by this administrative order shall expire June 6, 2014, unless a
Building Permit is obtained or an extension is granted in accordance with the provisions
of Section 11.02.06 of the St. Lucie County Land Development Code.

D. The Site Plan approval granted under this Order is specifically conditioned to the
requirement that the property owners, successors and assigns in interest, shall obtain all
necessary development permits and construction authorizations from the appropriate
State and Federal regulatory authorities including, but not limited to, the United States
Army Corps of Engineers, the Florida Department of Environmental Protection, North St.
Lucie Water Control District and the South Florida Water Management District, prior to
the issuance of any local building permits of authorizations to commence development
activities on the property described in Part B.
E. This Order shall become effective upon the date of approval indicated below. Should
the property owner, developer or authorized agent wish to appeal any condition
described in Part A above, all such appeals must be filed in writing with the County
Administrator within 30 days of the rendering of this Order, as described in Section
11.02.03(8), St. Lucie County Land Development Code. Should an appeal to this Order
be filed, no permitting reviews or further administrative action shall take place on the
processing of this development project until the appeal is resolved.
F. A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Planning and Development
Services Director and mailed to the developer and agent of record as identified on the
site plan application.
G. The conditions set forth in Part A are an integral nonseverable part of the site plan
approval granted by this Order. If any condition set forth is Section A is determined to
be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, the site plan approval granted by this order shall become
null and void.
H. This order shall be recorded in the Public Records of St. Lucie County.
ORDER effective the 6th day of June, 2013.
