On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, 13 adopted the St. Lucie County Land Development Code and has adopted amendments to 14 the Land Development Code through certain ordinances. 15 16 2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, 17 adopted Ordinance 12-003 granting the Planning and Development Services Director the 1s authority to make the determination after full analysis of all potential impacts that a 19 proposed use is in compliance with the provisions of the Land Development Code and the z o St. Lucie County Comprehensive Plan. 21 22 3. The determination to allow physical fitness center as a permitted use within the IL (Industrial, 23 Light) zoning district is consistent with the general purpose, goals, and objectives of the St. z 4 Lucie County Comprehensive Plan, the Land Development Code and Ordinance 12-003, is in 2 5 the best interest of the health, safety and public welfare of the citizens of St. Lucie County, 26 Florida. 27 2 a 4. The proposed amendment will not have an undue adverse effect on adjacent property, the 29 character of the neighborhood, traffic conditions, parking, utility facilities, or other matters 3o affecting the public health, safety, and general welfare within the IL (Industrial, Light) 31 zoning district. 32 3 3 NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services Director of 34 St. Lucie County, Florida: 35 36 The physical fitness center has been determined to be consistent with similar permitted uses in the 37 IL (Industrial, Light) zoning district, and, as such, is determined to be a permitted use in this zoning 38 district. 39 4o PART A. CrossFit is strength and conditioning program originally designed for tactical operation teams, military, martial artist and professional athletes. CrossFit now offer physical fitness programs at various levels for individuals regardless of experience. The Land Development Code (LDC) zoning regulations group physical fitness centers as a permitted use in Commercial, General (CG) zoning district classified under the Major Group 79 Amusement and Recreation Services. Pursuant to provisions in Ordinance 12-003 this memorandum is to request your determination related to allowing a physical fitness center as a permitted use in the IL zoning district. According to the analysis, a physical fitness training studio is similar in use and intensity to Vocational Schools (SIC 824) which is listed as a permitted use in IL zoning district. Background On June 15, 2004 the property where the CrossFit personal training studio is proposed was granted Major Site Plan approval for the project known as Runway's End Commerce Center. The site consists of two buildings with a total square footage of 40,000 on 4.5 acres. The property is located at 3250 St. Lucie Blvd on the northeast corner of the intersection of St. Lucie Boulevard and Industrial 33~d Avenue. The site was approved with 3 parking spaces per 1,000 square foot of floor area for a total of 124 parking spaces. The industrial flex space facility is currently vacant. The Runway's End Commerce Center is compliant with all aspects of the LDC including architectural standards. Analysis The subject property consist of two parcels (1428-702-1492-000/4 and 1428-702-1537- 000/2) zoned IL (Industrial, Light). The IL zoning district is to provide and protect an environment suitable for light manufacturing, wholesale, and warehousing activities that do not impose undesirable noise, vibration, odor, dust, or other offensive effects on the surrounding area. The proposed physical fitness training studio will not impose any undesirable qualities on the surrounding area. The open warehouse structure will provide the indoor area for training and equipment. 2. The LDC refers to the Standard Industrial Classification (SIC) Manual 1987 for details of the classification of uses in all zoning districts. Physical fitness has been categorized under Crossfit 772 W DA 720134642 July 10, 2013 Page2of2 Miscellaneous amusement and recreation services (SIC 7991) as a permitted use in CG zoning district. Since 1997 the NAICS that replaced the SIC Code now categorize physical fitness centers under Fitness and Recreational Sports Centers 713940 placing the use under its own category. The physical fitness establishments are no longer grouped under the general category of Major Group 79 Amusement and Recreation Services. Thereby creating a category that is not listed in any zoning district as a permitted, conditional or accessory use. 3. The physical fitness training studio is consistent with other permitted uses allowed in the IL zoning district that offer instructional programs for training. Vocational Schools (SIC 824) that also create an assembly environment are permitted uses in IL. The Industry Group (SIC 824) Vocational Schools include establishments primarily engaged in courses that offer instructions for data processing, business and secretarial, and specialized vocation courses such as aviation, construction equipment, nursing, restaurant operation are a few. 4. The leased area for the proposed physical fitness training studio is 4000 square feet which equates to approximately 10% of the total square footage of buildings on the site. 5. The physical fitness training studio will be located within an industrial flex space facility that provides 3 parking spaces per 1,000 square feet of gross floor area. The existing 124 parking spaces are expected to be sufficient to accommodate the use. Recommendation Based upon the foregoing analysis, staff recommends approval of permitting the proposed use in the subject zoning district based upon the finding that the proposed use: a) Is consistent with and of any equal or lesser intensity than other uses permitted in the zoning category. b) Is equal to or of a lesser intensity than other uses either currently existing or previously permitted at this location. c) Does not generate trips that exceed the LOS on surrounding roadways. d) Does not create a parking demand that exceeds the available spaces. e) Does not create noise, odor, dust, vibration, excess light, stormwater runoff or other potential nuisance that would impact adjacent uses or properties. f) Includes appropriate buffers to mitigate potential impacts on adjacent uses and properties. g) Is consistent with the general scope, scale and intensity of existing nearby uses. h) Is consistent with the purpose and intent of the zoning district, the Land Development Code and/or Comprehensive Plan.
