HomeMy WebLinkAboutPDS-13-021 - Summer Wind - House Bill 7019 Extension PDS ORDER 13-021 (File No. BCC 720134643) AN ORDER GRANTING A TWO-YEAR STATUTORY EXTENSION PROVIDED BY HOUSE BILL 7019 TO THE SCHEDULED EXPIRATION DATE TO THE PREVIOUSLY APPROVED MINOR SITE PLAN FOR THE PROJECT KNOWN AS SUMMER WIND. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for development order extension timely submitted and in accordance with the provisions of House Bill 7019 on behalf of G and G/Aqua III, LLC, and has made the following determinations: 1. On June 8, 2009, the St. Lucie County Planning and Development Services Director granted approval, through Resolution 09-002, to the petition of G and G/Aqua III, LLC, for the Summer Wind Minor Site Plan, on the property located at 6600 North Highway A1A, St. Lucie County in the HIRD (Hutchinson Island Residential District) Zoning District, and more particularly described in Par D below. 2. On August 30, 2010 the Planning and Development Services Director granted through PDS Order 10-013 an extension for two years pursuant to Chapter 2010-147, Laws of Florida with the new date of expiration being June 8, 2013. 3. On May 4, 2012, Florida Governor Rick Scott, signed into law, Chapter 2012-205, Laws of Florida, more commonly known as the "Growth Management Bill H67019" (the Bill). 4. The Bill provides that any local government issued development order or permit that has an expiration date of January 1, 2012 through January 1, 2014, may be eligible to the extended and renewed for a period of two (2) years following its date of expiration. 5. The Bill further provides that the request for statutory extension must be timely made in writing by December 31, 2012; identify the specific authorization for which the extension is requested, the intended use of the extension and the anticipated time frame for acting on the authorization. 6. On June 14, 2013, Florida Governor Rick Scott, signed into law, Chapter 2013-213, Laws of Florida, that extend the request for statutory extension made in writing by October 1, 2013. 7. The applicant applied for an extension in writing on March 3, 2013. JOSEPH E. Pursuant to the provisions of Chapter 2012-205, Laws of Florida the Summer Wind Minor Site Plan approval has been found to be eligible for and consistent with the provisions contained in Section 24 of HB 7019 an additional extension such that the approval granted under PDS Order 10-013 is extended for two-years and 'is now scheduled to expire June 8, 2015. B. All terms and conditions of previous approvals shall continue to remain in full force and effect unless otherwise amended. C. The property on which this development order extension is being granted is described as follows: THE SOUTH 150 FEET OF THE NORTH 450 FEET OF GOVERNMENT LOT 4 LYING EAST OF FLORIDA STATE ROAD AI A, SECTION 3, TOWNSHIP 34 SOUTH, RANGE 40 EAST, TOGETHER WITH ALL LITTORAL RIGHTS THEREUNTO APPEARING. Parcel ID# 1403-130-0001-000/7 D. The conditions set forth in Part B are an integral non severable part of the site plan approval granted by GM Order No. 09-002. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, this development order extension approval granted by this order shall become null and void.
