AN ORDER GRANTING A LOT SPLIT APPROVAL FOR
PROPERTY CONSISTING OF 2.621 ACRES LOCATED
ON STATE ROAD Al A
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the application for Lot Split approval submitted by Phoenix Realty Homes, Inc. for Idlewild
Hutchinson Island, LLC (Farrokh Patel, Manager)
1. Phoenix Realty Homes, Inc. petitioned for a lot split approval for property consisting of
2.62 acres of property in the HIRD (Hutchinson Island) Zoning District, located on the
east side of State Road A 1 A.
2. The division of the parent tract results in the creation of two lots to be known as Parcel
1-A consisting of 1.38 acres and Parcel 1-B consisting of 1.24 acres.
3. The Planning & Development Services staff has reviewed the lot split on the subject
property and found it to meet technical requirements of the St. Lucie County Land
Development Code and to be consistent with the St. Lucie County Comprehensive Pan.
4. The lot split will not have an undue adverse effect on adjacent property, the character of
the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting
the public health, safety, and general welfare.
5. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code provides
that no further division of an approved lot split is permitted unless a final record plat is
prepared and approved in accordance with the Code.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the
Phoenix Realty Homes, Inc. Lot Split is hereby approved as shown on the boundary
survey prepared by DJG Surveying and Mapping, Inc., dated February 8, 2013 subject
to the following condition:
Prior to issuance of a Vegetation Removal Permit or Exemption, and/or Building Permit
the recorded warranty deeds reflecting final division of the property with the legal
descriptions for each new parcel shall be provided to the Planning and Development
Services Department.

C. The Lot Split approval granted under this Order is specifically conditioned to the
requirement that the property owners, successors and assigns in interest, shall obtain all
necessary development permits and construction authorizations from the appropriate
State and Federal regulatory authorities including, but not limited to, the United States
Army Corps of Engineers, the Florida Department of Environmental Protection, North St.
Lucie Water Control District and the South Florida Water Management District, prior to
the issuance of any local building permits of authorizations to commence development
activities on the property described in Part B.
D. This Order shall become effective upon the date of approval indicated below. Should
the property owner, developer or authorized agent wish to appeal any condition
described in Part A above, all such appeals must be filed in writing with the Planning and
Development Services Department within 30 days of the rendering of this Order, as
described in Section 11.02.03(8), St. Lucie County Land Development Code. Should an
appeal to this Order be filed, no permitting reviews or further administrative action shall
take place on the processing of this development project until the appeal is resolved.
E. A copy of this Order shall be attached to the Boundary Survey drawings described in
Part A, which plan shall be placed on file with the St. Lucie County Planning and
Development Services Director.
F. The conditions set forth in Part A are an integral nonseverable part of the lot split
approval granted by this Order. If any condition set forth in Part A is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the approval granted by this order shall become null and void.
H. This order shall be recorded in the Public Records of St. Lucie County.
