HomeMy WebLinkAboutPDS-13-022 - American Legion Post #3181 - PDS No. 13-022 2 File No. SPMn 721034646 3 4 AN ORDER GRANTING APPROVAL FOR A 5 MINOR ADJUSTMENT TO A MINOR SITE PLAN 6 KNOWN AS AMERICAN LEGION POST #318. 7 8 WHEREAS, the St. Lucie County Planning and Development Services Director has 9 reviewed the request for a site plan adjustment submitted by American Legion Post 10 #318 and the comments of the St. Lucie County Development Review Committee on 11 this application, and has made the following determinations. 12 13 1. American Legion Post #318 requested a Minor Adjustment to a Minor Site 14 Plan to cover and existing 1,050 square foot patio to remain open air on three 15 sides. The subject 2.183 acre property is zoned CG (Commercial General) 16 and is located on the property described in Part B below. 17 18 2. American Legion Post #318 received Minor Site Plan approval via PDS Order 19 No. 12-026 on July 6, 2012 fora 6,300 s.f. social hall with a 144 s.f. covered 20 outdoor bar. 21 22 3. The Development Review Committee reviewed the Minor Adjustment and 23 found it to meet the technical requirements of the St. Lucie County Land 24 Development Code and to be consistent with the St. Lucie County 25 Comprehensive Plan. 26 27 4. The Minor Adjustment is consistent with the general purpose, goals, 28 objectives, and standards of the St. Lucie County Comprehensive Plan and 29 the St. Lucie County Land Development Code. 30 31 5. The site plan adjustment will not have an undue adverse effect on adjacent 32 property, the character of the neighborhood, traffic conditions, parking, utility 33 facilities, or other matters affecting the public health, safety and general 34 welfare. Any potential noise impacts to adjacent properties have been 35 mitigated in this Order with conditions outlined in Paragraph A. 36 37 NOW, THEREFORE, BE IT ORDERED: 38 39 A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development 40 Code, the Minor Adjustment to Minor Site Plan for the project known as 41 American Legion Post #318 is hereby approved as shown on the plan 42 drawings for the project prepared by Friscia Engineering dated July 15, 2013 File Number: SPMn 720134646 PDS Order 13-022 July 19, 2013 Page 1 JOSEPH E. All previous conditions of approval for the subject property, as 6 contained in PDS Order No. 12-026 shall remain in full force and 7 effect. 8 2. The daily hours of operation for the use shall be restricted from 10:00 9 a.m. to 12:00 midnight. 10 3. There shall be no live amplified music or entertainment in the covered 11 patio area or outdoors as noted on the site plan unless a Temporary 12 Special Event Permit is obtained and approved by the St. Lucie County 13 Planning and Development Services Department, Planning Division. 14 The property owner shall make application for such permit at least one 15 month in advance of any event. Upon issuance of said permit, the 16 property owner shall provide written notice to the Lake Lucie Estates 17 HOA at feast ten (10) calendar days in advance of an event. Such 18 notice shall include the date, time, type and purpose of the event along 19 with contact information. No event shall go past 9:00 p.m. 20 21 B. The property on which the Minor Adjustment to a Minor Site Plan approval is 22 being granted is described as follows: 23 24 LOT 2, SAVANNA PLAT #18, ACCORDING TO THE PLAT THEREOF, AS 25 RECORDED IN PLAT BOOK 63, AT PAGE 18, OF THE PUBLIC RECORDS 26 OF ST. LUCIE COUNTY, FL. 27 28 PARCEL ID# 3426-700-0002-000-0 29 30 C. The approvals granted by this administrative order shall expire on July 6, 31 2014 unless an extension is granted in accordance with the provisions of 32 Section 11.02.06 of the St. Lucie Land Development Code. 33 34 D. The Minor Adjustment approval granted under this administrative order is 35 specifically conditioned to the requirement that the petitioner, American 36 Legion Post #318, including any successors in interest, shall obtain all 37 necessary development permits and construction authorizations from the 38 appropriate State and Federal regulatory authorities including, but not limited 39 to, the United States Army Corps of Engineers, the Florida Department of 40 Environmental Protection, and South Florida Water Management District, 41 prior to the issuance of any local building permits of authorizations to 42 commence development activities on the property described in Part B. 43 File Number: SPMn 720134646 PDS Order 13-022 July 19, 2013 Page 2 1 2 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 E.
