HomeMy WebLinkAboutPDS-13-024 - Love's Travel Stop1 PDS 13-024 2 SPMJ 620134631 3 4 AN ORDER GRANTING APPROVAL FOR A MAJOR ADJUSTMENT TO A MINOR 5 SITE PLAN KNOWN AS LOVE'S TRAVEL STOP. 6 7 WHEREAS, the St. Lucie County Planning and Development Services Director has 8 reviewed the request for a site plan adjustment submitted by Love's Travel Stop and 9 made the following determinations. 10 11 1. Love's Travel Stop requested a Major Adjustment to a Minor Site Plan to 12 increase the size of the vehicle maintenance building (tire shop) from 1,200 13 square feet to 6,763 square feet. The subject 23.3 acre property is zoned IL 14 (Industrial, Light) and is located south of Orange Avenue and east of Kings 15 Highway as described in Part B below. 16 17 2. On January 20, 2012 Love's Travel Stop received Minor Site Plan approval 18 via PDS Order No. 12-008 fora 2,854 s.f. fast food restaurant, 6,358 s.f. 19 convenience store, 1,200 s.f. tire shop and 16 fuel stations. 20 21 3. On September 21, 2012 Love's Travel Stop received a Minor Adjustment to 22 the previous approved Minor Site Plan via PDS Order No. 12-032 to increase 23 the size of the convenience/retail store from 6,358 s.f. to 7,148 s.f., eliminate 24 seven truck parking spaces, revise the wet and dry retention areas, 25 reconfigure the tire barn, reduce the size of the lift station, and modify the 26 vehicular ingress/egress. 27 28 4. The Development Review Committee reviewed the Major Adjustment and 29 found it to meet the technical requirements of the St. Luce County Land 30 Development Code and to be consistent with the St. Lucie County 31 Comprehensive Plan. 32 33 5. The Major Adjustment is consistent with the general purpose, goals, 34 objectives, and standards of the St. Lucie County Comprehensive Plan and 35 the St. Lucie County Land Development Code. 36 37 6. The site plan adjustment will not have an undue adverse effect on adjacent 38 property, the character of the neighborhood, traffic conditions, parking, utility 39 facilities, or other matters affecting the public health, safety and general 40 welfare. 41 File Number: SPMJ 620134631 PDS Order 13-024 July 31, 2013 Page 1 JOSEPH E. The applicant has applied for and received a Certificate of Capacity, a copy 2 which is attached to this order as Exhibit A, as required under Chapter V, St. 3 Lucie County Land Development Code. 4 5 NOW, THEREFORE, BE IT ORDERED: 6 7 A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development 8 Code, the Major Adjustment to Minor Site Plan for Love's Travel Stop is 9 hereby approved as shown on the site plan and landscape drawings for the 10 project prepared by Gentile Holloway O'Mahoney and Associates, Inc. dated 11 July 16, 2013 and date stamped received by the St. Lucie County Planning 12 and Development Services Department on July 22, 2013; architectural 13 drawings for the project prepared by Blackledge and Associates dated July 14 11, 2013 and date stamped received by the St. Lucie County Planning and 15 Development Services Department on July 22, 2013; and engineering 16 drawings prepared by Resource Consulting Civil Engineers dated July 17, 17 2013 and date stamped received by the St. Lucie County Planning and 18 Development Services Department on July 22, 2013 on the property 19 described in Part B, subject to the following conditions: 20 21 1. Previous conditions #1 and #2 contained in PDS Order No. 12-008 22 shall continue to remain in full force and effect. 23 24 2. Previous conditions #2 through #5 contained in PDS Order No. 12-032 25 shall continue to remain in full force and effect. 26 27 3. All vehicle maintenance and repair services shall be conducted 28 indoors. 29 30 4. The approvals granted by this administrative order shall expire on July 31, 25 2015, unless an extension is granted in accordance with the provisions of 26 Section 11.02.06 of the St. Lucie Land Development Code. 27 28 D. The Major Adjustment approval granted under this administrative order is 29 specifically conditioned to the requirement that the petitioner, Love's Travel 30 Stop, including any successors in interest, shall obtain all necessary 31 development permits and construction authorizations from the appropriate 32 State and Federal regulatory authorities including, but not limited to, the 33 United States Army Corps of Engineers, the Florida Department of 34 Environmental Protection, and South Florida Water Management District, 35 prior to the issuance of any local building permits of authorizations to 36 commence development activities on the property described in Part B. 37 38 E. The conditions set forth in Part A are an integral nonseverable part of the site 39 plan approval granted by this order. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This order shall be recorded in the Public Records of St. Lucie County.
