LUCIE COUNTY, FLORIDA 9 1o WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 11 request to allow educational facility associated with agency approved management plans as a 12 permitted use in the RM-5 zoning district located at 2541 SE Walton Road and made the following 13 determinations: 14 15 1. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, 16 adopted the St. Lucie County Land Development Code and has adopted amendments to 17 the Land Development Code through certain ordinances. 1s 19 2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, 2 o adopted Ordinance 12-003 granting the Planning and Development Services Director the 21 authority to make the determination after full analysis of all potential impacts that a 22 proposed use is in compliance with the provisions of the Land Development Code and the 23 St. Lucie County Comprehensive Plan. 24 25 3. The determination to allow educational facility associated with agency approved 2 6 management plans as a permitted use within the RM-5 (Residential, Multiple-Family) zoning 2 ~ district until such time that the County rezones the subject property to CPUB (Conservation- 2 s Public) zoning district. 29 30 4. The determination to allow educational facility associated with agency approved 31 management plans as a permitted use within the RM-5 (Residential, Multiple-Family) zoning 32 district on the subject property is consistent with the general purpose, goals, and objectives of 33 the St. Lucie County Comprehensive Plan, the Land Development Code and Ordinance 12- 3 4 003, is in the best interest of the health, safety and public welfare of the citizens of St. Lucie 3 5 County, Florida. 36 37 5. This determination to allow the continued use and expansion of the educational facility 3 s associated with agency approved management plans within the Savannas Preserve State 3 9 Park that fronts on a collector road and is surrounded by State lands will not have an undue 4 o adverse effect on adjacent property, the character of the neighborhood, and traffic 41 conditions. 42 4 3 6. The proposed amendment will not have an undue adverse effect on parking, utility facilities, 4 4 or other matters affecting the public health, safety, and general welfare within the RM-5 4 5 (Residential, multiple-Family - 5) zoning district. PART A. SEVERABILITY If this Order or any provision thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. PART B. APPLICABILITY OF ORDINANCE This Order shall only constitute approval of educational facility associated with agency approved management plans as a permitted use and be applicable in the RM-5 (Residential, Multiple-Family - 5) zoning district for property located at 2541 SE Walton Road of the unincorporated area of St. Lucie County. LUCIE COUNTY, FLORIDA BY Mark Sa ee, AIC ,Director APPROVED AS TO FORM ANI BY WDA-720134652 August 12, 2013 PDS 13-025 Page 2 of 2 ~ a TO: Mark Satterlee, AICP, Di Planning and Development Services Department Planning Division MEMORANDUM THROUGH: Leslie Olson, Planning Manager FROM: Linda Pendarvis DATE: July 31, 2013 SUBJECT: Savannas Preserve State Park Education Center in RM-5 Zoning District This is to request your determination to permit the continued use and expansion of an educational facility associated with agency approved management plans in the Savannas Preserve State Park Education Center located at 2541 Walton Road within the RM-5 (Residential, Multiple-Family - 5) Zoning District. This request is in response to apre-application meeting with the representatives for Florida Department of Environmental Protection (FDEP), American Consulting Engineers of Florida, LLC and the City of Port St. Lucie. Background The subject property consists of a 4,200 square foot Education Center building with associated parking spaces on 14.63 acres. The applicant proposes to expand the existing facility to include a 3,000 square foot addition to the education center, improve the parking area, and construct sidewalks, entrance, observation deck, and other minor amenities. These improvements are being completed by the City of Port St. Lucie as part of a proprietary mitigation package in exchange for an easement from the State for use of State lands in conjunction with the Crosstown Parkway project. June 3, 1992, The Florida Department of Natural Resources, Division of State Lands acquired the subject property. August 17, 2001, GIS Department assigned an address to the subject property. Sometime between 1992 and 2001 the existing structure was constructed although staff was not able to locate a building permit. In 2004 St. Lucie County processed an overall county wide rezoning for publicly owned lands to be rezoned to CPUB, Conservation -Public, Zoning District. The resolution proposing this change was never recorded so the County rescinded the resolution on April 8, 2008 resulting in this property reverting back to the original RM-5 Zoning District The purpose of the CPUB zoning district is to provide an environment suitable for the protection, preservation or enhancement of public lands in the community, together with such other uses as may be compatible with public and quasi-public surroundings. It is the County's intention to rezone this property to CPUB Zoning District at some time in the near future. Until that time, we find that the existing use is compatible with the RM-5 zoning district designated on this property based on the following analysis. Savannas Preserve State Park Education Center July 31, 2013 Page 2 Analysis 1. The subject site has been in existence with the same use since 2001 according to County records. The subject property is surrounded by acres of vacant state owned preserved lands and is consistent with the general scope, scale and intensity of existing nearby uses. 2. If the resolution for the overall county wide rezoning had been properly executed this use determination would not be necessary because this property would have a CPUB zoning designation that is compatible to the existing use. 3. County staff is currently working on correcting the 2004 county wide rezoning and this property will soon be rezoned to CPUB. A use determination is being requested so that the property owner can make improvements that are compatible to the existing use until such time that the property is rezoned. 4. The subject property fronts on a collector road and the traffic generated will not have a negative impact to surrounding roadways or negatively impact the existing level of service for Walton Road. 5. The existing and proposed development is and will be consistent with the St. Lucie County landscaping and parking requirements. 6. The existing use is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan, the Land Development Code and Ordinance 12-003. The continued use of the subject site is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. Recommendation Based upon the foregoing analysis, staff recommends approval of permitting the proposed use on the subject property within the RM-5 zoning district based upon the finding that the proposed use: a) Is consistent with and of an equal or lesser intensity than the existing use. b) Is equal to or of a lesser intensity than the existing use permitted at this location. c) Does not generate trips that exceed the LOS on surrounding roadways. d) Does not create a parking demand that exceeds the available spaces. e) Does not create noise, odor, dust, vibration, excess light, stormwater runoff or other potential nuisance that would impact adjacent uses or properties. f) Includes appropriate buffers to mitigate potential impacts on adjacent uses and properties. g) Is consistent with the general scope, scale and intensity of existing nearby uses. h) Is consistent with the purpose and intent of the zoning district, the Land Development Code and/or Comprehensive Plan.
