AN ORDER GRANTING MINOR SITE PLAN APPROVAL
FOR THE FT. PIERCE/PORT ST. LUCIE SERVICE PLAZA
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the application for site plan approval submitted by Stride Contractors, Inc.,
reviewed the comments of the St. Lucie County Development Review Committee on this
application, and made the following determinations:
1. Ft. Pierce/Port St. Lucie Service Plaza provides for reconstruction of the existing
service plaza to provide new restaurant and convenience store facilities on 50+ acres of
property located on the north side of Crosstown Parkway within the Florida Turnpike
right-of-way, in St. Lucie County, Florida, more particularly described in Part B below.
2. The Development Review Committee has reviewed the site plan for the proposed
project and found it to meet technical requirements of the Land Development Code and
to be consistent with the St. Lucie County Comprehensive Plan.
3. The project will not have an undue adverse effect on adjacent property, the character of
the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting
the public health, safety, and general welfare.
4. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
5. The project will be constructed, arranged, and operated so as not to interfere with the
development and use of neighboring property, in accordance with applicable district
regulations.
6. The project is to be served by adequate public facilities and services.
7. Pursuant to the provisions of Land Development Code Section 7.06.01.E the applicant
has requested relief from the County's minimum width requirements for parking spaces
and aisles to allow the project to be designed consistent with the Florida Turnpike
criteria.

8. The applicant has applied for and received a Certificate of Capacity, a copy of which is
attached to this order, as required under Chapter V, ~St. Lucie County Land
Development Code.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
proposed Minor Site Plan to be known as Ft. Pierce/Port St. Lucie Service Plaza, is
hereby approved as shown on the site plan drawings for the project prepared by
Gannett Fleming Inc., dated November 9, 2012 and date stamped received by the St.
Lucie County Planning and Development Services Department on August 7, 2013,
subject to the following conditions:
Pursuant to the Administrative Relief provisions of Lancl Development Code
Section 7.06.01.E the relief form the County's minimum aisle and parking space
widths is granted and approved as shown on the above referenced site plan
document.
2. The County's issuance of development approval does not constitute compliance
with any federal and state requirements. Applicable, federal and state
approvals/permits are required prior to the commencement of any development
activity (i.e. clearing, grading, removing structures, etc.). 'The responsibility for
contacting federal and state agencies, procuring permits/approvals and
compliance with applicable laws are the sole responsibility of the applicant.
3. Per Florida Statute 125.022, the issuance of developme~~nt approval does not
create any liability on the part of the county if the applicant fails to obtain
requisite approvals or fulfill the obligations imposed by a state or federal agency
or undertakes actions that result in a violation of state or i~ederal law.
4. Copies of all applicable state or federal permits/written approvals are required by
the County prior to issuance of a Vegetation Removal Permit and any
development activity.
B. The property on which this Minor Site Plan approval is being granted is described as
follows:

of Section 6, Township 37 South, Range 40 East, lying in Saint Lucie County,

27 C. The approvals granted by this administrative order shall expire on August 21, 2015,
28 unless an extension is granted in accordance with the provisions of Section 11.02.06 of
29 the St. Lucie County Land Development Code.

31 D. The Final Site Plan approval granted under this Order is specifically conditioned to the
32 requirement that the property owners, successor and assigns in interest, shall obtain all
33 necessary development permits and construction authorizations from the appropriate
34 State and Federal regulatory authorities including, but not limited to; the United States
35 Army Corps of Engineers, the Florida Department of Environmental Protection, and the
36 South Florida Water Management District, prior to the issuance of any local building
37 permits of authorizations to commence development activities on the property
38 described in Part A.

40 E. This Order shall become effective upon the date of approval indicated below. Should
41 the property owner, developer or authorized agent wish to appeal any condition
42 described in Part A above, all such appeals must be filed in writing with the County

Administrator within 30 days of the rendering of this Order, as described in Section
11.02.03(8), St. Lucie County Land Development Code. ~~hould an appeal to this
Order be filed, no permitting reviews or further administrative action shall take place on
the processing of this development project until the appeal is, resolved.
F. A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Planning and Development
Services Director and mailed, return receipt requested to they developer and agent of
record as identified on the site plan applications.
G. The conditions set forth in Part A are an integral nonseverable part of the site plan
approval granted by this Order. If any condition set forth in Section A is determined to
be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, the site plan approval granted by this order shall become
null and void.
H. The Certificate of Capacity shall be valid for the same period .as this order. If this order
expires or otherwise terminates, the Certificate of Capacity shall automatically
terminate.
I. This order shall be recorded in the Public Records of St. Lucie County.
