1 PDS ORDER 13-026 y 2 File No.: WDA 320134607 3 4 AN ORDER GRANTING AN ADMINISTRATIVE RELIEF FOR 5 CERTAIN PROPERTY LOCATED AT 5799 S. US HWY 1 6 SITUATE IN ST. LUCIE COUNTY, FLORIDA 7 8 WHEREAS, the Planning and Development Services Director of St. Lucie County, Florida, 9 based on the written request and staff report, has made the following determinations: 10 11 1. Berean Church of God International Port St. Lucie, Inc. consists of two buildings (2,958 12 square foot building and 5,024 square foot building) on 1.43 acres of property in the CG 13 (Commercial, General) Zoning District located at 5799 S. US Hwy 1. 14 15 2. The property owner petitioned for administrative relief from the provisions of Section 16 7.06.02 Off-Street Parking of the St. Lucie County Land Development Code to allow for 17 a 30% reduction of parking spaces required for the religious facility to be located at 5799 18 S. US Hwy 1. 19 20 3. The property is allowed to use only the 2,958 square foot building for the church sanctuary 21 with 31 parking spaces. The applicant shall provide all additional required parking spaces in 22 the future when the 5,024 square foot building is renovated for the church sanctuary. 23 24 4. The Environmental Resource Department approved a 3 foot reduction in width for the 25 landscape buffer adjacent to the S US Hwy 1 right of way and a 4 foot reduction in width for 26 the landscape buffer adjacent to the adjoining properties. 27 28 5. After review of the analysis, including staff comments, exhibits, and the standards of 29 review for granting administrative relief set out in Section 10.01.02, St. Lucie County 30 Land Development Code, the Planning and Development Services Director has made 31 the following determinations: 32 33 The requested administrative relief has met the standards of review as set forth in 34 Section 10.01.02, St. Lucie County Land Development Code, and is not in conflict with 35 the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, 36 because: 37 38 a) The granting of the requested administrative relief arises from conditions that are 39 unique and peculiar to the land and building involved and the particular physical 40 surroundings and topographical condition of the specific property involved that would 41 result in unnecessary hardship to the owner if the provisions of this Code are literally 42 enforced; 43 44 b) The granting of the requested administrative relief would not impair or otherwise 45 injure adjacent property owners or improvements in the area in which the subject 46 property is located; 47 48 c) The granting of the requested administrative relief allows for the religious facility to 49 operate at 5799 S. The petition of Berean Church of God for an administrative relief from the provisions of Section 7.06.02, Off-Street Parking of the St. Lucie County Land Development Code to allow fora 30% reduction of parking spaces required for the religious facility to be located at 5799 S. US Hwy 1. The subject property was developed in 1960 prior to the adoption of the St. Lucie County Land Development Code (LDC). The building, vehicular use and parking area design, landscape buffers and the number of parking spaces do not conform to the current LDC requirements. The applicant is converting one of the existing buildings to a religious facility. The subject property was purchased by the church entity in January of 2012. A building permit application was submitted February 13, 2013 for the interior renovations of the existing building. The building department is processing permit number 1302-0175 for interior renovations to bring the 2,958 square foot building in compliance with the Florida Building Code. Pursuant to Ordinance No. 12-003 and the St. Lucie County Land Development Code, the property owner is requesting a 30% administrative relief for the required number of parking spaces needed for the religious facility. The applicant will be utilizing only the front building (2958 sq. ft.) for the church until they improve the rear of the building (5,024 sq. ft.) and the necessary paved parking for the additional sanctuary floor area. The building on the subject property was constructed in 1960 and since that time the Florida Department of Transportation has acquired right of way along the frontage of the subject parcel rendering existing parking spaces adjacent to US 1 right of way nonconforming. The existing paved vehicular use area will be resurfaced and stripped providing for 2 handicap spaces and 3 regular parking spaces to be located adjacent to the front of the building and the remaining spaces to be located in the rear of the building. Berean Church of God September 4, 2013 Page 3 Environmental Resource Department Per Section 7.09.04 vehicular use areas are to be screened from the right-of-way and adjacent properties. ERD is working with the applicant to place a continuous native hedge along US 1 right of way and adjacent properties. The applicant will be removing some pavement in order to place a continuous hedge within a 12'-5' foot wide buffer adjacent to US 1 right of way and six foot wide buffer along the perimeter of adjoining properties. Recommendation Pursuant to the provisions of Section 11.02.07 of the Land Development code and staff analysis, staff finds that the existing 31 parking spaces are adequate for the proposed use while located within the 2,958 square foot building until such time that the church expands their sanctuary floor area. Upon expansion, the church will be required to increase the parking spaces to meet the standards. The removal of pavement of parking spaces and vehicular use area adjacent to the right of way and adjoining properties will improve the landscape buffers.
