WHEREAS, the Board of County Commissioners of St. Lucie County, Florida,
(the "Board") has made the following determinations:
1. The Board has authorized the design, permitting and construction of certain
improvements to Midway Road (the "Project").
2. The County contracted with Lochner Consulting Engineers ("Lochner") to design
and permit the Project.
3. Lochner has completed right-of-way maps and construction plans for the Project
and these maps and plans have been reviewed and approved by the County
Engineer.
4. It is anticipated that the County will need to institute eminent domain
proceedings to acquire the interests necessary to proceed with and complete the
Project.
5. In the course of the eminent domain proceedings, the County Engineer and a
representative(s) from Lochner are authorized to testify concerning the Project.
6. In the course of the eminent domain proceedings, it may be in the public interest
to amend or revise the right-of-way maps and construction plans for the Project.
7. The County Engineer and a representative(s) of Lochner, who is/are designated
as the County's representative to testify in the eminent domain proceedings, are
hereby authorized to bind St. Lucie County with reference to changes or revisions
to the right-of-way maps and construction plans and drawings for the Project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of St. Lucie County, Florida:
Section 1: The above recitals are true and correct and incorporated herein by reference.
Section 2: In the course of any eminent domain proceedings, the County Engineer or a
representative(s) of Lochner are hereby authorized to bind the County on issues regarding
design and construction of the Project, including road and driveway connections, and to
authorize changes or revisions to the right-of-way maps and construction plans and
drawings for the Project.
Section 3: This Resolution shall take effect upon adoption.
