A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA, CLOSING, VACATING AND ABANDONING A PORTION OF A
UTILITY EASEMENT LOCATED ON LOT 2, BLOCK E, PALM GROVE SUBDIVISION
RECORDED IN PLAT BOOK 31, PAGES 4 - 4D OF THE PUBLIC RECORDS OF ST.
LUCIE COUNTY.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has
made the following determinations:
1. That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and
Section 11.10.01 et. seq. of the St. Lucie County Land Development Code, provide
that the County may adopt resolutions vacating easements for utilities in whole or in
part, which are under the jurisdiction of the Board of County Commissioners of St.
Lucie County, Florida.
2. Pursuant to Plat Book 31, Pages 4 - 4D, known as Palm Grove Subdivision, St. Lucie
County and the general public have a dedicated interest in the following described
land:
An easement for utility purpose over, under and across a parcel of land lying in a
portion of Lot 2, Block E, Palm Grove Subdivision as recorded in Plat Book 31 at
Pages 4 - 4D of the Public Records of St. Lucie County, Florida. Said easement being
more particularly described as follows:
Commence at the Northwest corner of Lot 2, Block E of Palm Grove Subdivision,
thence S 00° 11'22" E along the West line of said Lot 2 a distance of 34.89 feet to a
point on the South line of a 10 foot utility easement: thence N 89° 51'24" E a
distance of 6.00 feet to the Point of Beginning: thence N 00° 11'22" W parallel with
the West line of Lot 2, Block E a distance of 15.00 feet; thence N 89°51'24" E a
distance of 4.00 feet; thence S 00°11'22" E parallel with the West line of Lot 2, Block
E a distance of 15 feet; thence S 89°51'24" W a distance of 4.00 feet to the Point of

Said abandoned area containing 60 square feet more or less.
Bearing base: the West line of Lot 2, Block E, Palm Grove Subdivision is taken to
bear N 00°11'22"Wand all other bearings are relative thereto.
3. A Notice of Intent to Abandon was advertised on August 14, 2013 and August 21,
2013 and no objections were filed.
4. All relevant public utilities have provided written consent to the abandonment.
5. County staff has reviewed the petition and have filed no objections to the proposed
abandonment.
6. Property owners within 300 feet have been notified and filed no objections to the
abandonment.
7. On August 6, 2013, the Board of County Commissioners approved Permission to
Advertise for a Public Hearing on September 17, 2013.
8. On August 30, 2013, a Notice of Public Hearing was advertised in the St. Lucie News
Tribune.
9. It is in the best interest of the public to vacate and abandon a portion of the utility
easement on Lot 2 Block E in Palm Grove Subdivision more particularly described as
follows:
An easement for utility purpose over, under and across a parcel of land lying in a
portion of Lot 2, Block E, Palm Grove Subdivision as recorded in Plat Book 31 at
Pages 4 - 4D of the Public Records of St. Lucie County, Florida. Said easement being
more particularly described as follows:
Commence at the Northwest corner of Lot 2, Block E of Palm Grove Subdivision,
thence S 00° 11'22" E along the West line of said Lot 2 a distance of 34.89 feet to a

easement for utility purpose over, under and across a parcel of land lying in a portion
of Lot 2, Block E, Palm Grove Subdivision as recorded in Plat Book 31 at Pages 4 -
4D of the Public Records of St. Lucie County, Florida. Said easement being more
particularly described as follows:
