LUCIE COUNTY, FLORIDA 8 9 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and 10 evidence, including, but not limited to the staff report, has made the following determinations: 11 12 1. Fine Realty Corporation petitioned to extend a previous variance approval (BOA 13 Resolution No. 12-011) for an additional year as per Section 10.01.06 of the St. Lucie 14 County Land Development Code for the property located at 2601 North US Highway No. 15 1. This variance allowed the required recreational vehicle lot size to be reduced from 70 16 feet by 40 feet down to 60 feet by 30 feet for the development of a recreational vehicle 17 park known as Harbor Town RV & Resort. 18 19 2. On October 23, 2013, this Board held a public hearing on the petition, after publishing a 20 notice of such hearing in the newspaper, installing a sign on the property and notifying 21 by mail all owners of property within 500 feet of the subject property. 22 23 3. After consideration of the testimony presented during the public hearing, including staff 24 comments, and exhibits, the Board of Adjustment has made the following 25 determinations: NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. The petition of Fine Realty Corporation to extend a previous variance approval (BOA Resolution No. 12-011) for an additional year as per Section 10.01.06 of the St. Lucie County Land Development Code for the property located at 2601 North US Highway No.1. in the Recreational Vehicle Park (RVP) Zoning District is hereby granted based on the evidence, for the property depicted on the attached map as Exhibit "A" and described as follows: LEGAL DESCRIPTION: All that part of the North 358.8 feet of the South 1735.9 feet of the NE 1/4 lying West of U.S. Highway No. 1, Section 33, Township 34 South, Range 40 East, St. Lucie County, Florida. AND 43 Begin at the Southwest corner of the portion of the North 365.8 feet of the South 44 1377.1 feet of the Northeast quarter of Section 33, Township 34, South, Range 40 45 East, lying West of U.S. Highway No. 1, St. Lucie County, Florida. From the point 46 of beginning run North along the center line of Section 33 a distance of 365.8 feet 47 to a point; thence run East along the North line of the North 365.8 feet of the South 48 1377.1 feet of the Northeast quarter of Section 33, Township 34 South, Range 40 49 East, a distance of 400 feet to a point; thence run South a distance of 200 feet to a Page 1 of 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 point; thence run Southeasterly a distance of 193.77 feet to a point on the South line of the North 365.8 feet of the South 1377.1 feet of the Northeast quarter of Section 33, Township 34 South, Range 40 East, which point is 483 feet East of the point of beginning and 200.29 feet West of the West right of way line of new U.S. Highway No. 1; thence run West along the South line of the North 365.8 feet of the South 1377.1 feet of the Northeast quarter of Section 33, Township 34 South, Range 40 East, to the point of beginning. Subject to easements, restrictions and reservations of record and taxes for the year 2007 and thereafter. TOGETHER, with all the tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining. LOCATION: 2601 North US Highway No. 1, Fort Pierce, Florida PARCEL ID: 1433-120-0010-000-5 B. An appeal of the Board of Adjustment's action may be processed in accordance with Section 10.01.07 of the St. Lucie County Land Development Code. C. This variance shall expire on October 24, 2014 unless a building permit is granted in accordance with Section 10.01.06 of the St. Lucie County Land Development Code.
