HomeMy WebLinkAbout13-252RESOLUTION 2013-252 A RESOLUTION ACKNOWLEDGING THE RESULTS OF THE MAIL BALLOT REFERENDUM HELD ON OCTOBER 29, 2013 ON PETITION TO EXPAND THE BOUNDARIES OF THE ST. LUCIE COUNTY MOSQUITO CONTROL DISTRICT TO ADD TRADITION NO. 19, TOWNPARK PHASE ONE AND TRADITION PLAT NO. 19 REPEAT, TOWNPARK PHASE ONE WHEREAS, the St. Lucie County Mosquito Control District has made the following determinations: 1. Section 29, Chapter 87-510, Laws of Florida, establishes a procedure whereby the owners of property located outside of the boundaries of the District may petition the District to expand the boundaries of the District to include their property. 2. On August 20, 2013, the District adopted Resolution 13-171 directing the Supervisor of Elections to conduct a mail ballot referendum in accordance with the Mail Ballot Election Act on the following proposition to be voted upon by the qualified electors of St. Lucie County residing on the subject property to expand the boundaries of the District to add the property lying adjacent to the existing District boundaries in the area known asTownpark, as more particularly described in the legal description attached hereto and incorporated herein as "Exhibit A": EXPANSION OF ST. LUCIE COUNTY MOSQUITO CONTROL DISTRICT BOUNDARIES Shall the boundaries of the St. Lucie County Mosquito Control District be expanded to add the following described property lying west of the existing boundaries of the District: Tradition Plat No. 19, Townpark Phase One, as recorded in Plat Book 47, Pages 32-64 of the public records of St. Lucie County, Florida, and all replats thereof. YES NO 3. The election was duly and properly held in accordance with law and the votes cast in that election have been returned, delivered, and canvassed. 4. The County Canvassing Board has certified to this District the results of the election and the Certificate of County Canvassing Board is attached as "Exhibit B". 5. On October 29, 2013, a majority of qualified electors residing on the subject property that voted in the election approved the petition for the expansion of Mosquito Control District boundaries with 206 votes for approval and 16 votes for rejection; and NOW, THEREFORE, BE 1T RESOLVED, DECLARED, AND CERTIFIED by the Board of County Commissioners of St. Lucie County, Florida, sitting as the St. Lucie County Mosquito Control District: 1. That the total number ofvotes cast in the election by the qualified electors residing on the subject property at the time of the election was two hundred twenty-two (222). 2. That the total number of votes cast in the election by the qualified electors residing on the subject property at the time of said election in favor of the expansion of Mosquito Control District boundaries was two hundred six (206). 3. That the total number ofvotes case in the election by the qualified electors residing on the subject property at the time of said election against the expansion of Mosquito Control District boundaries was sixteen (16). 4. That the election was in all respects conducted in accordance with the law, all steps in connection with and preceding the election have been duly, regularly and lawfully taken, and all provisions of the statutes and constitution of the State of Florida have been duly complied with. 5. Thatthe returns shalt be and are hereby entered and recorded in the minutes of the District and this resolution shall be recorded in the minutes. 6. The Clerk of the Circuit Court is hereby directed to send a copy of the recorded resolution to the St. Lucie County Property Appraiser's Office and the Florida Department of Agriculture and Consumer Services. This Resolution shall take effect upon adoption. Walsh, Jr., County Judge; The Honorable Gertrude Walker, Supervisor of Elections; and The Honorable Tod Mowery, Chairman, Board of County Commissioners, constituting the Board of County Canvassers in and for said County, do hereby certify that we met on the29th day of October, A.D., 2013, and proceeded publicly to canvass the votes given for the Expansion of the Mosquito Control District Boundaries Election held on the 29`h day of October, A.D., 2013 as shown by the returns on file in the office of the Supervisor of Elections. We do hereby certify from said returns as follows. Shall the boundaries of the St. Lucie County Mosquito Control District be expanded to add the following described property lying west of the existing boundaries of the District? Tradition Plat No. 19, Townpark Phase One, as recorded in Plat Book 47, Pages 32-64 of the public records of St. Lucie County, Florida and all replats thereof.
