PIERCE BUICK-GMC WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: In March 20, 1986, the St. Lucie County Board of County Commissioners approved Resolution 86-48, granting Barrier Reed Buick-GMC Inc. site plan approval for an auto sales facility on 7.9 acres of property in the CG (Commercial, General) Zoning District, located on the west side of US Highway 1, approximately'/2 mile south of Midway Road in St. Lucie County, Florida for the property described in Part B below. 2. An application for a Minor Adjustment to the Major Site Plan project F/K/A Barrier Reed Buick-GMC and Rodger Dean Buick has been received that results in an overall decrease in the building area by 7,980 square feet, modifies a portion of the existing circulation and landscaping areas, and changes the site plan name to Ft. Pierce Buick- GMC. 3. The Development Review Committee has reviewed the site plan for the proposed project and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Development Review Committee Final Report forthe Ft. Pierce Buick-GMC MinorAdjustment to aMajor Site Plan, dated January 23, 2014. The applicant has applied for and received a Certificate of Capacity Exemption, a copy of which is attached to this order, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the Major Site Plan project to be known as Ft. Pierce Buick-GMC, is hereby approved as shown on the site plan drawings for the project prepared by The Velcon Group Inc., dated October 15, 2013, revised through December 13, 2013, and date stamped received by the St. Lucie County Planning and Development Services Director on January 13, 2014, subject to the following conditions: 1. Prior to the issuance of a building permit documentation must be provided that indicates the Florida Department of Transportation's approval of the proposed utility connections within the US Highway 1 right-of-way. 2. Prior to the issuance of the a building permit, the developer or his assigns, shall provide an executed copy of a final utility service agreement with the Fort Pierce Utilities Authority. 3. Prior to issuance of a certificate of occupancy, all Florida Exotic Pest Plant Council listed species shall be removed, including but not limited to, Australian pines, Brazilian pepper and carrotwood. 4. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 5. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which this Minor Adjustment to a Major Site Plan approval is being granted is described as follows: LOT 47, LESS THE NORTH 105 FEET, WHITE CITY SUBDIVISION, AS RECORDED IN PLAT BOOK 1, PAGE 23, IN THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPTING THE RIGHT OF WAY OF US HIGHWAY NO. 1. January 28, 2014 PDS Order 14 - 002 SPMN 1220134704 Page 2 1 Address: 5255 S. The approvals granted by this administrative order shall expire on January 28, 2016, 5 unless an extension is granted in accordance with the provisions of Section 11.02.06 of 6 the St. Lucie County Land Development Code. 7 8 D. The Site Plan approval granted under this resolution is specifically Conditioned to the 9 requirement that the petitioner, Garber Management Group, including any successors 10 in interest, shall obtain all necessary permits and authorizations, or notices of intent to 11 issue same, from the appropriate Local, State, and Federal regulatory authorities prior 12 to the issuance of any local building permits or authorizations to commence 13 development activities; however, the preceding sentence shall not preclude or delay the 14 issuance of local building permits or authorizations for development activities that are 15 not dependent on the PRIOR issuance of State or Federal permits or authorizations, or 16 notices of intent to issue same. 17 18 E. This Order shall become effective upon the date of approval indicated below. Should 19 the property owner, developer or authorized agent wish to appeal any condition 20 described in Part A above, all such appeals must be filed in writing with the County 21 Administrator within 30 days of the rendering of this Order, as described in Section 22 11.02.04(6), St. Lucie County Land Development Code. Should an appeal to this 23 Order be filed, no permitting reviews or further administrative action shall take place on 24 the processing of this development project until the appeal is resolved. 25 26 F. A copy of this Order shall be attached to the site plan drawings described in Part A, 27 which plan shall be placed on file with the St. Lucie Planning and Development 28 Services Director and mailed, return receipt requested to the developer and agent of 29 record as identified on the site plan applications. 30 31 G. The conditions set forth in Part A are an integral nonseverable part of the site plan 32 approval granted by this Order. If any condition set forth in Section A is determined to 33 be invalid or unenforceable for any reason and the developer declines to comply 34 voluntarily with that condition, the site plan approval granted by this order shall become 35 null and void. 36 37 H. The Certificate of Capacity Exemption, attached to this order, shall be valid for the 38 same period as this order. If this order expires or otherwise terminates, the Certificate 39 of Capacity Exemption shall automatically terminate. 40 41 I.
