WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a site plan adjustment submitted by Culpepper and Terpening, Inc. on behalf of Community Savanna Club Joint Venture and the comments of the St. Lucie County Development Review Committee on this application, and has made the following determinations. Community Savanna Club Joint Venture requested a Minor Adjustment to the Final Planned Unit Development (PUD) Site Plan for the relocation of the permitted entrance sign for Savanna Club PUD, located at the southeast corner of South US Hwy 1 and Savanna Club Blvd. The subject 3.24 acre property is zoned CG (Commercial, General) and is located on the property described in Part B below. 2. On April 27, 1982, the St. Lucie County Board of County Commissioners approved Resolution 82-58 for the Development of Regional Impact (DRI) known as Savannah Club. 3. Savanna Club DRI proposed to construct a residential mobile home subdivision comprising approximately 2,560 mobile homes with recreation complex, constituting a Development of Regional Impact located in St. Lucie County, east of U. S. Highway One and north of Walton Road. 4. Savanna Club DRI located the real estate sales office and models for the Savanna Club PUD on the subject property providing for landscaping, off-street parking and signage for the PUD sales center. 5. Savanna Club PUD Home Owners Association (HOA) wishes to continue to have an entrance sign located at this intersection. That determination to allow the continued use of the existing sign is found in Exhibit A. 6. The Development Review Committee has reviewed the site plan for the proposed project and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Final Staff Report for the Savanna Club PUD Entrance Sign Minor Adjustment, dated January 29, 2014. 8. The Minor Adjustment is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 9. The site plan adjustment will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor Adjustment is hereby approved as shown on the plan drawings for the project prepared by Culpepper and Terpening, Inc. dated December 27, 2013 and date stamped received by the St. Lucie County Planning and Development Services Department on January 6, 2014 on the property described in Part B, subject to the following conditions: Port St. Lucie Utilities Department No clearing or other site work shall commence until the developer, their successor or assigns has contacted the Port St. Lucie Utilities Department to ensure the location of utility infrastructure. Planning and Development Services 2. Prior to issuance of a building permit or vegetation removal permit for the construction of the Savanna Club PUD entrance sign, the developer, their successor or assigns, shall submit to St. Lucie County Planning and Development Services Department a sign easement recorded in public records. Environmental Resource Department 3. Prior to issuance of a building permit or vegetation removal permit for the construction of the Savanna Club PUD entrance sign, the developer, their successor or assigns, shall submit to the St. Lucie County Environmental Resource Department a landscape plan indicating the landscaped area around the base of the sign which must extend a minimum distance of three (3) feet in all directions. The landscaping shall consist of natural drought tolerant shrubs, hedges or similar vegetation materials in accordance with Section 9.02.01.D.6 of the Land Development Code. 4. Prior to issuance of a certificate of occupancy, all Florida Exotic Pest Plant Council listed species shall be removed. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 6. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which the Minor Adjustment approval is being granted is described as follows: ST. The approvals granted by this order shall expire on January 26, 2016 unless an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie Land Development Code. D. The Minor Adjustment approval granted under this administrative order is specifically conditioned to the requirement that the petitioner, Community Savanna Club Joint Venture, including any successors in interest, shall obtain all necessary permits and authorizations, or notices of intent to issue same, from the appropriate Local, State, and Federal regulatory authorities prior to the issuance of any local building permits or authorizations to commence development activities; however, the preceding sentence shall not preclude or delay the issuance of local building permits or authorizations for development activities that are not dependent on the prior issuance of State or Federal permits or authorizations, or notices of intent to issue same. E. This Order shall become effective upon the date of approval indicated below. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Planning and Development Services Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. G. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. Lee Dobbins 1903 south 25th Street, Suite 200 Fort Pierce, FL 34947 Re: Revised Letter of October 18, 2013 Savanna Club PUD Entrance Sign Parcel ID#3414-501-1915-160/1 Dear Mr. Dobbins, This letter is in response to your recent request for a determination regarding the continued use and potential relocation of the permitted entrance sign for Savanna Club PUD, located at the southeast corner of South US Hwy 1 and Savanna Club Blvd. The subject property has a zoning designation of CG (Commercial, General) and was the original sales center for the Savanna Club PUD development. It is our understanding that the subject property will change ownership and Savanna Club PUD Home Owners Association (HOA) wishes to continue to have an entrance sign located at this intersection but not hinder the ability of the proposed development to place ground signs for their business. In accordance with the sign regulations Section 9.01.01 of the Land Development Code (LDC), the PUD (Planned Unit Development) zoning district allows for a ground sign to be located at the principle entrance into a residential development not to exceed 32 square feet and 10 feet in height. When the subject parcel is sold it will no longer be a part of the Savanna Club PUD development. The LDC does not provide for entrance signs to be located outside of the PUD development, although Planning division policy has allowed for entrance signs for nonresidential and residential developments to be placed at intersections subject to permanent sign easements recorded in public records. Staff's determination, once an appropriate site on the subject parcel is located, is that the existing 180 square foot entrance sign for Savanna Club PUD together with existing water, landscape and column features be relocated within the subject parcel, with a permanent sign easement recorded in public records. If a new sign design is desired (i.e. a design different from the existing sign), the size and height requirements of PUD entrance signs will apply. Please review Section 9.02.01.D prior to selecting the new location of the entrance sign. Paragraph 4 of this section describes the placement and the height of a ground sign. when the subject property abuts the intersection of two rights of ways. d •• s Subsequently, future development of the subject property will be permitted to have ground signs in accordance with Section 9.01.01 Permitted Permanent Signs within the CG zoning district not inclusive of the Savanna Club PUD entrance sign. The Savanna Club entrance sign will not be used in calculations of the number or size of signs allowed for the primary use.
