HomeMy WebLinkAboutPDS-14-007 - Indian River National Bank at Business Park Drive2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 PDS Order 14-007 SPMN 1120134698 AN ORDER GRANTING A MINOR ADJUSTMENT TO AN EXISTING MINOR SITE PLAN PROJECT KNOWN AS INDIAN RIVER NATIONAL BANK AT BUSINESS PARK DRIVE WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: October 3, 2005, the St. Lucie County Planning and Development Services Director approved GM-05-026, granting Indian River National Bank at Business Park Drive site plan approval for 4,000 square foot bank building in the CG (Commercial, General) Zoning District, located on the northwest corner of US Highway 1 and Business Park Drive in St. Lucie County, Florida for the property described in Part B below. 2. An application for a Minor Adjustment to the Minor Site Plan project f/k/a MidFlorida Credit Union has been received that results in the following site changes: to expand the three lane drive thru and canopy to a five lane drive thru and canopy, reconfigure parking layout on the north side, relocate loading zoning and replace existing loading zone with parallel parking, and changes the site plan name to MidFlorida Credit Union. 3. The Development Review Committee has reviewed the site plan for the proposed project and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Development Review Committee Final Report for the MidFlorida Credit Union Minor Adjustment to Minor Site Plan, dated February 12, 2014. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the Minor Site Plan project to be known as MidFlorida Credit Union, is hereby approved as shown on the site plan drawings for the project prepared by LP Engineering Services, LLC, dated September 2013, revised through January 2014, and date stamped received by the St. Lucie County Planning and Development Services Director on January 21, 2014, subject to the following conditions: The location of proposed generator must have a three (3) foot clearance completely around the generator for inspection and maintenance. 2. The location of proposed propane tank must be set back a minimum of five (5) feet from any ignitable object. 3. Prior to issuance of Certificate of Occupancy, the applicant shall install the required landscaping in order to be consistent with the October 3, 2005 approved Landscape Plan. 4. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 5. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which this Minor Adjustment to a Minor Site Plan approval is being granted is described as follows: A parcel of land being a portion of Lots 10 and 11, Block 2, Section 26, Township 36 South, Range 40 East, as shown on the map of St. Lucie Gardens, a subdivision according to the plat thereof recorded in Plat Book 1, Page 35, Public Records of St. Lucie County, Florida, being described as follows: Commence at the intersection of the west line of Lot 8, Block 2, of said St. Lucie Gardens, thence South 27°31'37" East, 1780.91 feet, along the west right-of-way of U.S. Highway 1 to a point being North 27°31'37" West, 229.54 feet from the northeast corner of St. Lucie Business Park, as recorded in Plat Book 28, Pages 9 and 9A, Public Records of St. Lucie County, Florida, said point being the Point of Beginning; thence North 89°42'05" West, leaving said west right-of-way line, 219.39 feet; thence South 00°17'55" West, 203.00 feet to the north line of St. Lucie Business Park; thence South 89°42'05" East, along said north line, 326.54 feet to the northeast corner of said St. Lucie Business Park, said point also being on the aforesaid west right-of-way line of U.S. Highway 1; thence North 27°31'37" West, along said February 12, 2014 PDS Order 14 - 007 SPMN 1 1 201 34698 Page 2 1 west right-of-way line, 229.54 feet to the Point of Beginning. The approvals granted by this administrative order shall expire on February 12, 2016, 8 unless an extension is granted in accordance with the provisions of Section 11.02.06 of 9 the St. Lucie County Land Development Code. 10 11 D. The developer is advised as part of this minor adjustment approval for MidFlorida Credit 12 Union, including any successors in interest, the developer shall obtain all applicable 13 development permits and construction authorizations from the appropriate State and 14 Federal and local regulatory agencies including, but not limited to, the United States 15 Army Corps of Engineers, the Florida Department of Environmental Protection, and 16 South Florida Water Management District, and the St. Lucie County Environmental 17 Resources and Building Departments prior to the commencement of any development 18 activities on the property described in Part B. Issuance of this permit by the County 19 does not in any way create any rights on the part of the developer to obtain a permit 20 from a state or federal agency and does not create any liability on the part of the 21 County for issuance of this permit if the developer fails to obtain requisite approvals or 22 fulfill the obligations imposed by a state or federal agency or undertake actions that 23 may result in a violation of state or federal law. 24 25 E. This Order shall become effective upon the date of approval indicated below. Should 26 the property owner, developer or authorized agent wish to appeal any condition 27 described in Part A above, all such appeals must be filed in writing with the County 28 Administrator within 30 days of the rendering of this Order, as described in Section 29 11.02.03(8), St. Lucie County Land Development Code. Should an appeal to this 30 Order be filed, no permitting reviews or further administrative action shall take place on 31 the processing of this development project until the appeal is resolved. 32 33 F. A copy of this Order shall be attached to the site plan drawings described in Part A, 34 which plan shall be placed on file with the St. Lucie Planning and Development 35 Services Director and mailed, return receipt requested to the developer and agent of 36 record as identified on the site plan applications. 37 38 G. The conditions set forth in Part A are an integral nonseverable part of the site plan 39 approval granted by this Order. If any condition set forth in Section A is determined to 40 be invalid or unenforceable for any reason and the developer declines to comply 41 voluntarily with that condition, the site plan approval granted by this order shall become 42 null and void. 43 44 H. This order shall be recorded in the Public Records of St. Lucie County.
