LUCIE COUNTY 5 DESIGNATING PROPERTIES ON SEGMENTS OF SR-713/KINGS HIGHWAY, SR- 6 614/INDRIO ROAD, AND SR-70/OKEECHOBEE ROAD AS ELIGIBLE TO APPLY FOR 7 "EMINENT DOMAIN WAIVERS," AS SPECIFIED IN ORDINANCE NO. 11-005. 8 9 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, adopted 10 Ordinance No. 11-005 on February 1, 2011, which amended the St. Lucie County Land 11 Development Code to provide for eminent domain wavers, and added Section 10.03.00 12 "Eminent Domain Waiver," which provides for the use of a waiver where an eminent domain 13 action renders a site non-conforming. 14 15 Ordinance No. 11-005 states "Sections 10.03.00 and 10.3.01 shall be applicable only after the 16 Board of County Commissioners adopts a resolution approving the use of eminent domain 17 waivers for specific public projects." The Florida Department of Transportation has specific 18 public transportation projects on SR-713/Kings Highway at SR-614/Indrio Road and on SR- 19 713/Kings Highway from SR-70/Okeechobee Road to north of Picos Road, which necessitates 20 the use of an eminent domain action and requests that the following roadway segments be 21 designated as eligible to apply for eminent domain waivers. 22 23 FDOT Public Transportation Projects 24 25 1. SR-713/Kings Highway at SR-614/Indrio Road 26 2. SR-713/Kings Highway from SR-70/Okeechobee Road to north of 27 Picos Road 28 29 Based on testimony and evidence, including, but not limited to the staff report, the following 30 determinations have been made: 31 32 1. Properties located within the above referenced segments of SR-7131Kings 33 Highway, SR-614llndrio Road, and SR-70/Okeechobee Road should be 34 eligible for eminent domain waivers. 35 36 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie 37 County, Florida, that: 38 39 A. The Florida Department of Transportation has public transportation projects on SR- 40 713/Kings Highway at SR-614/Indrio Road and on SR-713/Kings Highway from SR- 41 70lOkeechobee Road to north of Picos Road, which require the use of eminent domain 42 actions. These roadway segments are designated as specific public project and 43 properties within the limits of these segments are eligible to use eminent domain 44 waivers. 45 46 B.
