LUCIE 9 COUNTY, FL. 10 11 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 12 request to allow asemi-truck tractor/trailer storage and transfer facility as a permitted use and an 13 alternate design for an existing 1,536 s.f. modular office building located at 8456 Orange Avenue 14 and made the following determinations: 15 16 1. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, 1~ adopted the St. Lucie County Land Development Code and has adopted amendments to 18 the Land Development Code through certain ordinances. 19 20 2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, 21 adopted Ordinance 12-003 granting the Planning and Development Services Director the 22 authority to make the determination after full analysis of all potential impacts that a 23 proposed use is incompliance with the provisions of the Land Development Code and the 24 St. Lucie County Comprehensive Plan. 25 2 6 3. On October 23, 2012, the Board of County Commissioners of St. Lucie County, Florida, 2 ~ adopted Resolution No. 12-116 approving an Amendment to the Official Zoning Atlas that 28 changed the zoning from I (Institutional) to CG (Commercial, General) on a 2.87 acre 2 9 portion of the subject property. 30 31 4. On April 22, 2014, the Planning and Development Services Director granted an Ordinance 32 No. 12-003 Waiver, Deferral and Alternative (WDA) approval for certain infrastructure and 33 landscape improvements on the subject property as described in Exhibit A. 34 35 5. On May 14, 2014, Red Tail Design Group on behalf of Kelly Lawhon requested a WDA 3 6 (Waiver, Deferral and Alternative -Ordinance No. 12-003) Determination from the Planning 37 and Development Services Director to allow asemi-truck tractor/trailer storage and 38 seasonal transfer facility as a permitted use in the CG zoning district and a design 3 9 alternative for an existing 1,536 s.f. modular office building on the property described in Part 4 o B below. 41 4 2 6. Planning staff has performed a detailed analysis of the proposed use, including the design 4 3 alternative, and determined it to be consistent with the general purpose, goals, and 4 4 objectives of the St. Lucie County Comprehensive Plan, the Land Development Code and W DA-520144764 PDS 14-024 May 30, 2014 Page 1 of 4 Ordinance No. 12-003 is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. The analysis is found in the Planning and Development Services Department Memorandum entitled WDA Use and Design Guidelines Determination -One Plan B, dated May 30, 2014. 7. The proposed use and design alternative will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare within the CG (Commercial, General) zoning district. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services Director of St. Lucie County, Florida: The semi truck tractor/trailer storage and seasonal transfer facility use, including the design alternative for the 1,536 s.f. modular office building have determined to appropriate for this specific property in the CG zoning district upon demonstration of compliance with the conditions listed in Part A. A. The property on which this use and design alternative determination is being made is subject to the following conditions: 1. The transport or distribution of trucks shall only occur on a seasonal basis between the months of October and April. 2. The parking and storage of any semi truck tractors or trailers shall be located on the rear half of the property only. 3. There shall be no idling of semi-truck tractors on the property between the hours of 10:00 p.m. and 7:00 a.m. 4. There shall be no repairs of truck tractors or trailers on the property. 5. The modular office building shall be removed from the property if the use is discontinued or abandoned for twelve (12) consecutive months. 6. The approved Landscape Plan submitted by Land Design South (date stamped March 18, 2014) by the Planning and Services Department and on file with the Environmental Resources Department shall be revised by June 30, 2014. The following revisions are needed to screen the modular trailer from the Orange Avenue right-of-way: a. Provide a continuous four (4) foot high hedge at the time of planting in front of the modular office building (east of the entrance to the east side property line) and along the east side of the building. b. Provide a treatment of live oaks (between the modular office building and the Orange Avenue right-of-way and between the building and the east property line). The location and number of live oaks to be determined by the Environmental Resources Department. The installation of these landscape materials shall be completed by July 22, 2014 B. The subject property 7.75 acres located on the north side of Qrange Avenue, approximately % mile west of North Rock Road. The property is currently being used to stare storage containers and office trailers. C?ur Waiver, Deferral and Alternative (WDA) review of the site determined the documents submitted will bring the existing development into compliance with the minimum technical requirements of the St Lucie County Land Development Gode. The following is an outline of the approvals granted under the VttDA review subject to conditions of approval that must be complied with in 90 days of the date of this letter. Environmental Resource Dg rtment The Environmental Resource Department's (ERD) review of the WDA Landscape Plan submitted by Land Design South and date stamped March 18, 2014 by the Planning and Development Services Department indicate no negative environmental impacts associated with the existing commercial storage facility with parking, landscaping and infrastructure improvements. The eight (8) foot high opaque fence woad fence and required landscaping is represented as a visual screen, in between non-rosidentlel Bind resic~ntial properties, The applicant w'rtl provided twenty (20} additional native slash pine trees, to fulfill the tree mitigation requirements from the 4/412011 After-the-Fact Vegetation Removal Permit. All native vegetation onsite shall be preserved to meet the required landscaping. In addition, a revised landscape plan dated March 8, 2014 has been reviewed and approved by ERD. Engineering Departmen# The County Engineering Department completed their review of the WDA Grading & Drainage Plan submitted by Engineering Design & Construction, Inc and date stamped January 15, 2014 by the Planning and Develaprnent Services Department. Please be aware that the Florida Department of Transportation is currently constructing paved shoulders on Orange Avenue (CR 68).
