HomeMy WebLinkAboutPDS-14-023 - Johnston Road1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 PDS NO. 14-023 File No. LS 520144761 AN ORDER APPROVING LOT SPLIT FOR PROPERTY CONSISTING OF 9.49 ACRES LOCATED ON JOHNSTON ROAD WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for an Lot Split submitted by Parker Davis on behalf of Custom Herbicide Applicators, Inc. and made the following findings: 1. The Lot Split application submitted on behalf of Custom Herbicide Applicators has been approved for property consisting of 9.49 acres of property zoned AG-1 (Agriculture - 1 du/ac) Zoning District, located on the west side of Johnston Road and legally described as follows: THE SOUTHEAST'/4 OF THE NORTHWEST'/4 OF THE SOUTHEAST'/4 OF SECTION 27, TOWNSHIP 34 SOUTH, RANGE 39 EAST, LANDS LYING IN ST. LUCIE COUNTY, FLORIDA, LESS ROAD RIGHT OF WAY AS DESCRIBED IN OFFICIAL RECORDS BOOK 254, PAGE 2567 AND OFFICIAL RECORDS BOOK259, PAGE 1852, PBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. PARCEL ID: 1327-424-0001-00016 2. The division of the parent tract creates two lots depicted on the Boundary Survey created by Charles Arnold, PLS dated May 5, 2014. The two lots are further described on the boundary survey as proposed parcel "A", the north tract, and proposed parcel "B", the south tract. 3. The Development Review Committee has reviewed the lot split on the subject property and found it to meet technical requirements of the Code and the standards of review in Section 11.03.04. D of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Pan. 4. Staff has provided an analysis of the parcel's eligibility for aone-time split pursuant to Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found in a project summary and memorandum dated May 1, 2014 entitled Custom Herbicide Lot Split, File No. LS 520114761. 5. Section 11.03.04.E of the Land Development Code provides that no further division is permitted unless a final record plat is prepared and submitted in accordance with the Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 10.01.14 of the St. Lucie County Land Development Code, the Custom Herbicide Lot Split is hereby approved as shown on the boundary survey prepared by Charles Arnold, PLS dated May 5, 2014 by the Planning and Development Services Director, subject to the following conditions: JOSEPH E. Prior to issuance of a Vegetation Removal Permit or Exemption, and/or Building Permit, the recorded warranty deeds reflecting final division of the property describing the newly created parcels shall be provided to the Planning and Development Services Department. 2. Within 90 days after receiving lot split approval or prior to the issuance of the building permit, whichever comes first, the applicant shall convey the required road right of way for Johnston Road. Manner and form of conveyance shall be acceptable to the County Attorney. The sketch and legal description shall be prepared by a Florida licensed surveyor. Pursuant to Section 7.05.03 of the LDC, the applicant may be granted credits against road impact fees. B. The approval granted by this administrative order shall expire on May 23, 2014 unless warranty deeds are recorded in Public Records of St. Lucie County or an extension request is submitted in writing 30 days prior to the expiration date accompanied by a complete explanation of the reasons that the extension is necessary. C. A copy of this Order shall be attached to the boundary survey described in hereinabove, and shall be placed on file in the Planning and Development Services Department. D.
