HomeMy WebLinkAboutPDS-14-012 - Brocksmith Road1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 z7 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 PDS NO. 14-012 File No. LS 520144765 AN ORDER GRANTING A LOT SPLIT APPROVAL FOR PROPERTY CONSISTING OF 18.48 ACRES LOCATED ON BROCKSMITH ROAD WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Lot Split approval submitted by Stephen Tierney on behalf of the property owner, Conrad F. and Melissa M. Guettler and made the following determinations: Conrad F. and Melissa M. Guettler petitioned the Planning Division for a Lot Split approval for property consisting of 18.48 acres of land in the AG-5 (Agricultural - 5 du/ac) Zoning District, located on the west side of Brocksmith Road, approximately 1.5 miles north of Okeechobee Road. 2. The division of the parent tract creates two lots described as follows: a) West 1h of Lots 14 & 15, Block 2 of the Subdivision of McNurlen Farms b) East 1h of Lots 14 & 15, Block 2 of the Subdivision of McNurlen Farms 3. The Development Review Committee has reviewed the lot split on the subject property and found it to meet technical requirements of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Pan. 4. Staff has provided an analysis of the parcel's eligibility for aone-time lot split pursuant to Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found in a memorandum dated June 2, 2014 entitled Melissa M. Guettler and Conrad F. Guettler, LS 520144765. 5. The lot split will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. An analysis of the Standards of Review (LDC Section 11.03.04.D) may be found in the Planning and Development Services memorandum described above. 6. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code provides that no further division of an approved lot split is permitted unless a final record plat is prepared and approved in accordance with the Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Conrad F. and Melissa M. Guettler Lot Split is hereby approved as described above in Section two and shown on the boundary surrey (Exhibit A) prepared by Alexander J. Piazza PSM, Inc. dated 11/26/2013 and date stamped 12/03/2013 by the Planning and Development Services Department, subject to the following condition of approval: File No.: LS 520144765 June 2, 2014 JOSEPH E. This easement will connect the lots to Brocksmith Road and satisfy the requirements for nonconforming lots of record as provided under Section 10.00.04(A)(1). The easement documents shall be recorded in public records with St. Lucie County Clerk of Court. B. The property on which this Lot Split approval is being granted is described as follows: Lots 14 and 15, Block 2, of McNurlen Farms Subdivision according to the Plat thereof recorded in Plat Book 4, Page 56 Public Records of St. Lucie County, Florida Parcel ID Numbers: 2320-501-0027-000/2 C. The approvals granted by this administrative order shall expire on June 2, 2015, unless warranty deed or quit claim deed is recorded in Public Records of St. Lucie County or an extension request is submitted in writing 30 days prior to the expiration date accompanied by a complete explanation of the reasons that the extension is necessary. D. A copy of this Order shall be attached to the boundary survey drawing described in Part A, which plan shall be placed on file with the St. Lucie County Planning and Development Services Director.
