AN ORDER OF THE PLANNING & DEVELOPMENT
SERVICES DIRECTOR OF ST. LUCIE COUNTY GRANTING
APPROVAL FOR A MINOR ADJUSTMENT TO A
CONDITIONAL USE FORMERLY KNOWN AS SOUTHEAST
RECYCLING, INC., TO BE KNOWN AS RECYCLING
SERVICES OF FLORIDA LOCATED AT 4203 METZGER
ROAD AND SITUATE IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Planning & Development Services Director has reviewed the application
for a Minor Adjustment to change the ownership and name of a Conditional Use Permit and made the
following determinations:
Recycling Services of Florida, Inc. petitioned the Planning & Development Services Director for a
Minor Adjustment to change the ownership and name of an existing Conditional Use Permit
formerly known as Southeast Recycling, Inc. The subject property is located at 4203 Metzger
Road, Fort Pierce within the IL (Industrial, Light) Zoning District.
2. This Minor Adjustment to change the ownership and name of a Conditional Use Permit authorizes
the continued use of the recycling facility for nonferrous materials in accordance with Section
7.10.12(A) Land Development Code.
On February 9, 1993 the Board of County Comm issioners granted site plan approval for a project
known as Southeast Recycling Corp. fora 9,900 square foot addition to an existing recycling
facility.
4. The project is consistent with the general purpose, goals, objectives, and standards of the St.
Lucie County Comprehensive Plan and the St. Lucie County Land Development Code.
5. The project will not have an undue adverse effect on adjacent property, the character of the
neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public
health, safety, and general welfare.
6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on
the immediate vicinity through building design, site design, landscaping, and screening.
7. The project will be operated so as not to interfere with the development and use of neighboring
property, in accordance with applicable district regulations.
8. The project is served by an onsite septic system and well.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.07.05(E)(2) of the St. Lucie County Land Development Code, the
proposed Minor Adjustment to change the ownership and name of a Conditional Use Permit
formerly known as Southeast Recycling, Inc., shall now be known as Recycling Services of

Florida, Inc., is hereby approved by the St. Lucie County Planning & Development Services
Director on the property described in Part B, subject to the following conditions of approval.
1. Except as otherwise provided in this paragraph, activities occurring on the site, including
storage of the collected materials shall be conducted under roof. The only activities
permitted in the open are those connected with the unloading and loading of materials as
part of the operation being conducted in the existing on site structures. No outside
storage of recycled materials of any kind shall be permitted overnight.
2. The collection activity shall be surrounded by a fence, wall or vegetative screening. The
required fence shall be constructed without openings except for one entrance and one
exit. Such gates shall be closed and securely locked at all times, except during business
hours.
3. Within 90 days of Minor Adjustment to the Conditional Use approval, all invasive exotic
vegetation located within the Conditional Use area shall be removed (LDC Section
7.09.05).
4. Within 90 days of Minor Adjustment to the Conditional Use approval, the applicant shall
install landscaping consistent with the February 2, 1993 approved site plan. Alternative
landscaping materials may be allowed with ERD approval.
5. Within 90 days of Minor Adjustment to the Conditional Use approval, the applicant shall
install curb stops for the parking areas to prevent vehicle encroachment into the
landscape areas.
6. Within 90 days of Minor Adjustment to the Conditional Use approval, the applicant shall
remove the dumpsters from underneath the oak trees
7. The issuance of County development permit does not in any way create any rights on the
part of the applicant to obtain a permit from a state or federal agency and does not
create any liability on the part of the County if the applicant fails to obtain requisite
approvals or fulfill the obligations imposed by a state or federal agency or undertakes
actions that result in a violation of state or federal law.
8. All other applicable state or federal permits must be obtained before commencement of
the development.
B. The property on which this Minor Adjustment to an approved Conditional Use Permit is being
granted is described as follows:

C. The approvals granted by this administrative order shall expire on May 28, 2015, unless
Certificate of Zoning Compliance for a Business Tax License is secured within 12 months from
the date of approval, or an extension is granted in accordance with the provisions of Section

D. The approvals and authorizations granted by this PDS Order are for the purpose of obtaining
zoning compliance from St. Lucie County and are not assigned to any other party or institution.
Should Recycling Services of Florida, Inc. choose or decide to assign this business to another
entity or individual, an adjustment to the Conditional Use Permit shall be required.
E. The conditions set forth in Part A are an integral non-severable part of the Conditional Use Permit
approval granted by this administrative adjustment. If any condition set forth in the PDS Order is
determined to be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with the condition, the Conditional Use Permit approval granted shall become null and
void.
F. This Conditional Use Permit shall be deemed to authorize only the particular use for which it was
issued and shall automatically expire and cease to be of any force or effect if such use shall, for
any reason, be discontinued for a period of twelve (12) consecutive months.
G. A copy of this Order shall be placed on file with the St. Lucie County Planning & Development
Services Director and mailed, return receipt requested to the developer and agent of record as
identified on the applications.
H. This order shall be recorded in the Public Records of St. Lucie County.
ORDER effective the 28th day of May, 2014.
