LUCIE COUNTY, FLORIDA 7 8 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and 9 evidence, including, but not limited to the staff report, has made the following determinations: 10 11 1. Kevin Jacksonti presented a petition for a Variance from the Provisions of Section 12 7.04.01(Table 7-10), of the St. Lucie County Land Development Code, to permit the 13 continued use of a storage shed to encroach a maximum of 3.72 feet into the minimum rear 14 setback of 5 feet required for accessory storage structures in the RS-4 (Residential, Single 15 family - 4 du/ac) Zoning District. The subject project is located at 3404 Avenue R, Fort 16 Pierce, for the property depicted on the attached map as Exhibit "A" and described below. 17 18 2. On April 23, 2014, this Board of Adjustment held a public hearing on the petition, after 19 publishing a notice of such hearing and notifying by mail all owners of property within 500 2 0 foot of the subject property. Following staff's presentation, the applicant's presentation and 21 public comments this Board requested that the petitioner provide response forms from the 22 adjacent property owners to the rear of the property and continued the item to the May 28, 23 2014 meeting. 24 25 3: On May 28, 2014, this Board of Adjustment held the public hearing on the petition. 26 27 4. After consideration of the testimony presented during the public hearing, including staff 2 8 comments and the standards of review for.granting variances set out in Section 10.01.02, St. 2 9 Lucie County Land Development Code, the Board of Adjustment has made the following 3 0 determination: 31 - 3 2 The requested variance has met the standards of review as set forth in Section 3 3 10.01.02, St. Lucie County Land Development Code and is not in conflict with the 3 4 goals, objectives, and policies of the St. Lucie County Comprehensive Plan, 3 5 because: 36 37 1. The variance granted is the minimum variance that will make possible the 3 8 reasonable use of the land and structure already constructed in the location 3 9 requiring the variance. The encroachment is abutting a 12 foof alley 4 0 between the adjacent properties in the rear (north). 41 42 2. The applicant provided response forms in favor from the adjacent property 43 owners in the rear (north). The variance granted will not have adverse 44 impacts to other property or improvements in the neighborhood. 45 4 6 3. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. Kevin Jackson., presented a petition for a Variance from the Provisions of Section 7.04.01(Table 7-10), of the St. Lucie County Land Development Code, to permit the continued use of a storage shed that encroaches a maximum of 3.72 feet into the minimum rear setback of 5 feet required for accessory storage structures in the RS-4 (Residential, Single family - 4 du/ac) Zoning District. B. The property on which this variance is being granted is described as follows: SUNLAND GARDENS BLK 5 LOTS 11, 12 AND WLY 1/2 OF LOT 13 (PARCEL ID#: 2405-601-0095-000/6) (Location: 3404 Avenue R, Fort Pierce ) C. Based on the testimony and evidence presented, this variance is approved. D. An appeal from the Board of Adjustment's action may be processed in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. E. This variance shall expire twelve months from the date of adoption unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code.
