HomeMy WebLinkAbout14-093RESOLUTION 14-093 A RESOLUTION AMENDING RESOLUTION NO. 87-184, AS AMENDED, TO ESTABLISH PENALTIES FOR VIOLATION OF ANIMAL SHELTER STANDARDS AS SET FORTH IN SECTION 1-4-35 (ANIMAL SHELTER STANDARDS) AND SECTION 1-4-36 (INSPECTIONS), ST. LUCIE COUNTY CODE OF ORDINANCES AND COMPILED LAWS; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. On September 29, 1987, the Board adopted Resolution No. 98-184, which established penalties for violations of Article II (Animal Control) of Chapter 1-4 of the St. Lucie County Code of Ordinances and Compiled Laws. 2. On September 27, 1994, the Board Resolution No. 94-210 which established penalties for violations of provisions added to Article II of Chapter 1-4 pursuant to Ordinance No. 94-05. 3. On July 23, 2002, the Board adopted Resolution No. 02-84 which increased penalties for violation of Article II of Chapter 1-4 to reflect the increased cost of providing animal control services. 4. On April 3, 2007, the Board adopted Ordinance No. 97-010 which established a registration requirement for dogs and cats in the unincorporated areas of the County effective October 1, 2007. 5. On August 28, 2007, the Board adopted Resolution No. 07-225 which increased the penalties for violation of Article II to reflect the increased cost of providing animal control services. 6. On November 27, 2007, the Board adopted Resolution No. 07-369 which further established a penalty for failure to register an animal as required under Section 1-4-29 of the St. Lucie County Code of Ordinances and Compiled Laws. 7. On October 15, 2013, the Board adopted Ordinance No. 13-040 which amended Chapter 1-4 to provide for the adoption of standards for the operation of animal shelters by resolution. 8. On October 15, 2013, the Board adopted Resolution No. 13-224 which established standards for the operation of animal shelters. Page 1 of 3 8. Section 1-4-36 provides for the inspection of animal shelters to determine compliance with adopted animal shelter stands and the levy of fines for failure to come into compliance with such standards pursuant to Section 1-4-26. 9. It is appropriate and necessary to further amend the penalties established under Resolution No. 87-184, as amended, to establish penalties for failure to comply with animal shelter standards adopted by the Board. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida, Resolution No. 87-184, as amended, is hereby further amended as follows: 1. Section A is amended to add the following fines: Section Description of Offense First Offense Second Offense Third Offense 1-4-35.A Administration and $100.00 $200.00 Mandatory record keeping Court Appearance ("MCA") 1-4-35.6 Standard Operating $200.00 $400.00 MCA Procedures 1-4-35.C Population levels $200.00 $400.00 MCA 1-4-35.D Enclosures and housing $200.00 $400.00 MCA 1-4-35.E Euthanasia and spay/neuter $200.00 $400.00 MCA Protocols 1-4-35.F Compliance with statutory $200.00 $400.00 MCA Requirements 2. This resolution shall take effect upon the date of adoption.
