LUCIE COUNTY GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO A CONDITIONAL USE FORMERLY KNOWN AS THE TEACHER'S PLACE, TO BE KNOWN NOW AS STORYBROOKE PRESCHOOL ACADEMY LOCATED AT 3366 SOUTH 25 STREET IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning & Development Services Director has reviewed the application for a Minor Adjustment to change the ownership and name of a Conditional Use submitted by Karina Nunez, and made the following determinations: 1. Karina Nunez petitioned the Planning & Development Services Director for a Minor Adjustment to change the ownership and name of an existing Conditional Use formerly known as The Teacher's Place, now known as Storybrooke Preschool Academy. The subject property is located at 3366 South 25th Street. The subject 5.5 acre parcel (2428- 322-0002-000-3) has split zoning of AR -1 (Agricultural, Residential -1 du/acre) on the north half and I (Institutional) on the south half. The Conditional Use permit for child care/preschool (SIC 8322/8351) applies only to the southern portion of the property that is zoned Institutional (I). 2. The Minor Adjustment to change the ownership and name of a Conditional Use, which was originally instituted as a permitted use under the 1986 Land Development Code, meets the technical requirements of the Land Development Code, Section 11.07.05(E)(2)(a)(7), and is consistent with the St. Lucie County Comprehensive Plan, as outlined in the staff report dated June 12, 2014 and titled "CU Minor Adjustment: Storybrooke Preschool Academy LLC.". 3. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 5. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 6. Pursuant to Section 11.07.05(E)(2)(a)(7) of the St. Lucie County Land Development Code, the proposed Minor Adjustment to change the ownership and name of a Conditional Use formerly known as The Teacher's Place, now known as Storybrooke Preschool Academy, is hereby approved by the St. Lucie County Planning & Development Services Director on the following described property: South portion of parcel 2428-322-0002-000-3 COMMENCE at the Southwest corner of the Northwest one-quarter of the Southwest one-quarter of Section 28, Township 35 South, Range 40 East, St Lucie County, Florida; run North 00° 11' S0" West (assumed bearing) along the west line of said Section 28, a distance of 691 feet; thence run North 89° 58' 30" East, a distance of 623.59 feet; thence run North 00° 10' 06" West, a distance of 200 feet; thence run South 89° 58' 30" West, a distance of 182.76 feet; thence run South 89° 58' 30" West, a distance of 130.00 feet; thence run South 00° 11' 50" East, a distance of 60 feet to the POINT OF BEGINNING. B. The approvals granted by this administrative order shall expire on May 30, 2015, unless a Certificate of Zoning Compliance is secured within 12 months from the date of approval, or an extension is granted in accordance with the provisions of Section 11.07.05(F) of the St. Lucie County Land Development Code. C. The approval of the Minor Adjustment to the Conditional Use to change the ownership and the name granted under this Development Order is specifically conditioned to the requirement that the petitioner, Karina Nunez, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. D. A copy of this Order shall be placed on file with the St. Lucie County Planning & Development Services Director and mailed, return receipt requested to the developer and agent of record as identified on the applications. E. This order shall be recorded in the Public Records of St. Lucie County.
