HomeMy WebLinkAboutPDS-14-042 - The Crossing - Oleander Avenue Campus1" 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 PDS Order No. 14-042 SPMN 620144777 AN ORDER GRANTING A MINOR ADJUSTMENT TO AN EXISTING SITE PLAN PROEJCT TO BE KNOWN AS THE CROSSING -OLEANDER AVENUE CAMPUS WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. The Crossing, a Network of Community Churches., submitted an application for a minor site plan adjustment to change the site plan name and reduce the proposed square footage of the religious facility complex located at 5200 Oleander Avenue in St. Lucie County, Florida for the property described in Part B below. 2. On October 20, 1992, the St. Lucie County Board of County Commissioners approved Resolution 92-240, granting site plan approval fora 43,058 square foot project known as New Hope Baptist Church located at 5200 Oleander Avenue in St. Lucie County, Florida. 3. The Development Review Committee has reviewed the proposed site plan adjustment and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. 4. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Development Review Committee Final Report for the Crossing -Oleander Avenue Campus, dated September 8, 2014. 5. The applicant has applied for and received a Certificate of Capacity Exemption, a copy of which is attached to this order, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the Site Plan project to be known as The Crossing - September 12, 2014 PDS Order No. 14 - 042 JOSEPH E. Prior to issuance of a Certificate of Occupancy or within 90 days of this site plan approval, whichever comes first, the applicant, owner or assigns shall convey 32 feet of road right-of-way for Oleander Avenue. Manner and form of the conveyance shall be acceptable to the County Attorney. 2. Prior to issuance of a Certificate of Occupancy or within 90 days of this site plan approval, whichever comes first, the applicant, owner or assigns shall construct a 6 foot wide sidewalk along this projects Oleander Avenue road frontage. 3. Prior to the issuance of a building permit for any additional buildings or structures within the project, the Planning and Development Services Planning Division shall review and approve the proposed structure for consistency with Land Development Code Section 7.10.24. 4. Prior to issuance of a Vegetation Removal Permit or Exemption, the developers, their successor or assigns, shall conduct apre-construction meeting with construction personnel and Environmental Resources Department staff, to verify vegetation protection measures have been installed. 5. Prior to construction of the Phase II multiuse facility provide an undated landscape plan indicating the required five (5) foot wide foundation planting space between driveways, sidewalks, and the proposed buildings. [Land Development Code 7.10.24.C.h.2] 6. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state orfederal law. 7. The property on which this Minor Adjustment approval is being granted is described as 2 follows: 3 4 Beginning at a stake at the center of OleanderAvenue and Fourth Street, according 5 to the Plat of White City, being recorded in Plat Book 1, Page 23, of the Public 6 Records of St. Lucie County, Florida, thence run east 1060 feet, thence run east 7 495.00 feet; thence run west 1060.00 feet to the center of Oleander Avenue; thence 8 run south 495.00 feet to the Point of Beginning, excepting there from the following 9 tract of land, to wit; 10 11 Beginning at the intersection of Oleander Avenue and Fourth Street, run east 12 400.00 feet; thence run north 217.50 feet; thence run west 400 feet to the east right- 13 of-way line of Oleander Avenue; thence run south along right-of-way line 217.50 14 feet to the Point of Beginning, said Plat of White City Florida; being recorded in Plat 15 Book 1, Page 23, of the Public Records of St. Lucie County, Florida. 16 17 And also the west 36.00 feet thereof. 18 19 C. The developer is advised as part of this minor adjustment approval for the Crossing - 20 Oleander Avenue Campus, including any successors in interest, the developer shall 21 obtain all applicable development permits and construction authorizations from the 22 appropriate state, federal and local regulatory agencies including, but not limited to, 23 the United States Army Corps of Engineers, the Florida Department of Environmental 24 Protection, South Florida Water Management District, and the St. Lucie County 25 Environmental Resources and Building Department priorto the commencement of any 26 development activities on the property described in Part B. Issuance of this 27 development order by the County does not in any way create any rights on the part of 28 the developer to obtain a permit from a state or federal agency and does not create any 29 liability on the part of the County for issuance of this development order if the developer 30 fails to obtain requisite approvals or fulfill the obligations imposed by a state of federal 31 agency or undertake actions that may result in a violation of state or federal law. 32 33 D. This Order shall become effective upon the date of approval indicated below. Should 34 the property owner, developer or authorized agent wish to appeal any condition 35 described in Part A above, all such appeals must be filed in writing with the County 36 Administrator within 30 days of the rendering of this Order, as described in Section 37 11.02.03(8), St. Lucie County Land Development Code. Should an appeal to this 38 Order be filed, no permitting reviews or further administrative action shall take place on 39 the processing of this development project until the appeal is resolved. 40 41 E. A copy of this Order shall be attached to the site plan drawings described in Part A, 42 which plan shall be placed on file with the St. Lucie County Planning and Development September 12, 2014 SPMN 620144777 PDS Order No. 14 - 042 Page 3 Services Director and mailed to the applicant and agent of record as identified on the site plan applications. F. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. The Certificate of Capacity Exemption, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity Exemption shall automatically terminate. H. This order shall be recorded in the Public Records of St. Lucie County.
