A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
ST. LUCIE COUNTY GRANTING A WAIVER TO MIDWAY ST. LUCIE,
LLC WITH CONDITIONS FROM THE REQUIREMENTS OF SECTION
7.05.07 OF THE LAND DEVELOPMENT CODE REQUIRING PAVED
ACCESS TO NEW DEVELOPMENTS
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
the testimony and evidence, including but not limited to the staff report, has made the
following determinations:
1. Midway St. Lucie, LLC received preliminary plat approval for the project known
as Selvitz Crossing from the City of Fort Pierce Planning and Zoning Commission on March 11,
2014. The proposed project is located east of Selvitz Road, west of Christensen Road and north
of Devine Road. The project is comprised of twelve lots, two storm water tracts and a road
right-of-way tract to be dedicated to the City of Ft. Pierce. Ten residential lots abut
Christensen Road and two commercial lots abut Selvitz Road. A map depicting the proposed
development site and access road (Christensen Road) is attached as Exhibit "A."
2. The applicant has applied for a paving waiver and entered into an agreement to
pay a Fair Share Contribution towards the paving of Christensen Road.
3. On October 7, 2014, this Board held a public hearing to consider the adoption of
a Resolution after publishing and mailing notice. This Board granted approval of a waiver,
with conditions, from the paving requirement for the access road.
4. Pursuant to Section 7.05.07 B.2, the Board may require the applicant to provide
a fair share contribution toward the cost of paving Christensen Road.
5. Unpaved roads generally cost more to maintain and can negatively impact
emergency vehicle access.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
ST. LUCIE COUNTY, FLORIDA:
A. Pursuant to Section 7.05.07 of the Land Development Code, the requested
waiver to pave Christenson Road providing access to the property described below is hereby
granted on the property described as follows:
THE NORTH HALF OF THE SOUTHWEST QUARTER, THE NORTH HALF OF THE SOUTHEAST
QUARTER OF THE SOUTHWEST QUARTER AND THE NORTHEAST QUARTER OF THE SOUTHWEST
QUARTER OF THE SOUTHWEST QUARTER, ALL IN SECTION 32, TOWNSHIP 35 SOUTH, RANGE 40
EAST, ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THOSE PORTIONS OF THE ABOVE
DESCRIBED PROPERTY DESCRIBED IN RIGHT OF WAY DEEDS RECORDED AT O.R. BOOK 140,
PAGE 207, AND O.R. BOOK 140, PAGE 198, AND ALSO LESS AND EXCEPT RIGHT-OF-WAY FOR
NORTH ST. LUCIE WATER MANAGEMENT DISTRICT CANAL NO. 101.
AND TOGETHER WITH:
THE SOUTH ONE-HALF OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF
SECTION 32, TOWNSHIP 35 SOUTH, RANGE 40 EAST, ST. LUCIE COUNTY, FLORIDA. EXCEPTING
THEREFROM, EASEMENTS FOR PUBLIC ROADS AND DRAINAGE CANALS
6. The approval granted herein for the requested waiver is subject to the following
conditions:
1. Prior to the recording of the final plat, the applicant shall enter into a
Maintenance Agreement with St. Lucie County for that part of Christensen Road lying north of
Midway Road and south of the NSLWCD Canal #101. The applicant shall provide a surety in the
amount of $70,000.00. Manner and form of surety shall be approved by the County Attorney.
2. Within 90 days after receiving final plat approval, the applicant shall convey the
required road right-of-way for Christensen Road (20-feet). Manner and form of conveyance
shall be acceptable to the County Attorney. The sketch and legal description shall be prepared
by a Florida licensed surveyor and mapper.
3. Within 90 days after receiving final plat approval, the applicant shall convey the
required road right-of-way for Selvitz Road (20-feet). Manner and form of conveyance shall
be acceptable to the County Attorney. The sketch and legal description shall be prepared by a
Florida licensed surveyor and mapper.
C. A copy of this Resolution shall be forwarded to the City of Fort Pierce Planning
Department and mailed, return receipt requested to the developer and agent of record as
identified herein.
E. ADOPTION.
This Resolution shall be recorded in the Public Records of St. Lucie County.
