LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: Petition of RaceTrac Petroleum, Inc. for two (2) variances from the following Sections of the St. Lucie County Land Development Code to construct a driveway that would provide ingress located adjacent to Savanna Club Boulevard for a proposed 5,928 s.f. convenience store/gasoline station. a) Section 7.05.06(C)(2)(a)(2) -Driveways, which requires that the nearest edge of any driveway servicing a residential or non-residential use generating more than three hundred (300) trips per day, as determined by the standard ITE trip generation rates shall be a minimum of one hundred fifty (150) feet from the parallel base building line, and b) Section 7.05.06(C)(2)(e) -Driveways, which requires that the nearest perpendicular edge of any two driveways on the same property shall be separated by a minimum of one hundred fifty (150) feet. 2. On September 24, 2014 this Board held a public hearing on the petition, after publishing a notice of such hearing, installing a sign on property and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The requested variances do not meet the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because a) The proposed ingress is located in close proximity to a major arterial (U. S. Highway No. 1) and would create a traffic hazard; and b) The variances do not arise from conditions that are unique and peculiar to the land, structures, and buildings involved. There are no physical or topographical conditions that would result in unnecessary hardship. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: JOSEPH E.
