Savannas Preserve State Park petition includes the addition of a 3,039 square foot building and support facilities to the existing Savannas Preserve State Park Education Center located at 2541 Walton Road, approximately 1 mile east of US Highway 1, Port St. Lucie, in St. Lucie County, Florida; more particularly described in Part B below. 2. On August 12, 2013, PDS Order 13-025 was granted to allow educational facilities associated with agency approved management plans as a permitted use in the RM -5 (Residential, Multiple Family) Zoning District for the subject property. 3. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. Pursuant to the provisions of Land Development Code Section 7.06.01.E the applicant has requested administrative relief from the County's minimum width requirements for parking aisles to allow the existing parking area to be resurfaced consistent with the existing dimensions, one foot of relief is proposed. 6. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Development Review Committee Final Report for the Savannas Preserve State Park Minor Site Plan, dated April 14, 2014. 7. The applicant has applied for and received a Certificate of Capacity Exemption, a copy of which is attached to this order, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan to be known as Savannas Preserve State Park, is hereby approved as shown on the site plan drawings for the project prepared by American Consulting Engineers of Florida, LLC., dated November 9, 2012 and revised through the date stamped plans received by the St. Lucie County Planning and Development Services Department on February 27, 2014, subject to the following conditions: 1. The applicant, successor or assign shall execute an agreement to pay a fee - in -lieu of construction for the concrete sidewalk along Walton Road and remit to the County the required funds within 90 days after receiving final site plan approval. The acceptable method of payment shall be a certified check payable to St. Lucie County. 2. Within 360 days after receiving final site plan approval, the applicant shall convey the required road right of way easement for Walton Road. Manner and form of conveyance shall be acceptable to the County Attorney. The sketch and legal description shall be prepared by a Florida licensed surveyor and mapper. Pursuant to Chapter 7.05.03 of the Set. Lucie County Land Development Code, the applicant may be granted credits against road impact fees. 3. Prior to the issuance of any construction authorizations, the applicant shall obtain written confirmation from the St. Lucie County Fire District, or otherwise demonstrate by substantial creditable evidence, that water supply, evacuation facilities and emergency access are satisfactory to provide adequate fire protection. 4. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 5. All other applicable state or federal permits must be obtained before commencement of the development. B. The approvals granted by this administrative order shall expire on December 2, 2016, 18 unless an extension is granted in accordance with the provisions of Section 11.02.06 19 of the St. Lucie County Land Development Code. 20 21 D. The developer is advised as part of this site plan approval, including any successors 22 in interest, the developer shall obtain all necessary permits and construction 23 authorizations from the appropriate Local, State, and Federal regulatory agencies 24 including but not limited to the United States Army Corps of Engineers, the Florida 25 Department of Environmental Protection, the South Florida Water Management 26 District, and the St. Lucie County Environmental Resources and Building Departments 27 prior to the commencement of any development activities on the property described 28 in Part B. Issuance of this approval by the County does not in any way create any 29 rights on the part of the developer to obtain a permit from a state or federal agency 30 and does not create any liability on the part of the County for issuance of this permit if 31 the developer fails to obtain requisite approvals or fulfill the obligations imposed by a 32 state or federal agency or undertake actions that may result in a violation of state or 33 federal law. 34 35 E. This Order shall become effective upon the date of approval indicated below. Should 36 the property owner, developer or authorized agent wish to appeal any condition 37 described in Part A above, all such appeals must be filed in writing with the County 38 Administrator within 30 days of the rendering of this Order, as described in Section 39 11.02.03(B), St. Lucie County Land Development Code. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. G. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. H. The Certificate of Capacity shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. 1.
