LUCIE COUNTY, FLORIDA WHEREAS, the Planning and Development Services Director of St. Lucie County, Florida, based on the written request and staff report, has made the following determinations: 1. Harold Brumund, Holiday Out HOA President petitioned for Administrative Relief from the provisions of Section 7.06.03 of the St. Lucie County Land Development Code to allow for the reduction of one off-street parking space from the two off-street parking spaces required for certain residential parcels with FPL transformer boxes within the Holiday Out subdivision. The subject subdivision is located at 17025 South Ocean Drive. 2. Planning and Development Services Department, Planning Division staff has performed a detailed analysis of the request and determined it to be consistent with the St. Lucie County Land Development Code. The analysis is found in the Planning and Development Services Department Memorandum entitled Holiday Out Subdivision (Administrative Relief) dated February 11, 2015. The requested administrative relief has met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code, and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because: A. The granting of the requested administrative relief arises from conditions that are unique and peculiar to the land and building involved and the particular physical surroundings and topographical condition of the specific property involved that would result in unnecessary hardship to the owner if the provisions of this Code are literally enforced, B. The granting of the requested administrative relief would not impair or otherwise injure adjacent property owners or improvements in the area in which the subject property is located; C. The granting of the requested administrative relief allows for a reduction in required parking for all parcels with residences that have FPL transformer boxes within the front and side yard setbacks. The requested variance meets the general spirit and intent of the St. Lucie County Land Development Code and the St. Lucie County Comprehensive Plan. NOW, THEREFORE, BE IT ORDERED: A. The petition of Harold Brumund, Holiday Out HOA President for Administrative Relief from the provisions of Section 7.06.03, of the St. Lucie County Land Development Code is hereby approved for the Holiday Out subdivision located at 10725 South Ocean Drive, and depicted on the attached map as Exhibit "A". Said approval will allow a one parking space reduction in the required amount of off-street parking for residential parcels with FPL transformer boxes located in the front or side yard setbacks, subject to the following condition: 1. If the FPL transformer box is removed from any residential parcel, it shall be the responsibility of the HOA to notify the property owner to construct and provide the required additional parking space on the parcel that meets County Land Development Code requirements. B. An appeal of the Planning and Development Services Director's action may be processed in accordance with Section 11.11.02 of the St. Lucie County Land Development Code. C. This order shall be recorded in the Public Records of St. Lucie County. ORDER effective the 11 th day of February, 2015.
