WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a deferral to construct a vehicular use area in accordance with the provisions of Land Development Code, Section 7.06.00 — Off Street Parking and Loading for property located at 920 Angle Road and made the following determinations: 1. CAW. LLC is requesting a two year deferment to construct an all-weather surface vehicular use area in accordance with the provisions of the Land Development Section 7.06.00 -Off Street Parking and Loading for property located at 920 Angle Road. 2. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code and has adopted amendments to the Land Development Code through certain ordinances. 3. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to allow for certain on-site improvements, including the construction of a vehicular use area to be deferred to a future date. 4. This Waiver, Deferral and Alternative approval will permit the issuance of zoning compliances to J&M Towing and Septech Industries, Inc. at 920 Angle Road subject to the property coming into compliance with Section 7.06.02(8)(4) ADA Accessibility of the Land Development Code. 5. The Waiver, Deferral, and Alternative Committee reviewed the request and Planning Staff has performed an analysis of the request to allow the deferral for the construction of a vehicular use area is found in the Planning and Development Services Department Memorandum entitled 920 Angle Road, CAW, LLC dated June 25, 2015. 6. The proposed improvements will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 7. All reasonable steps have been taken to minimize any adverse effect of the proposed improvements on the immediate vicinity through building design, site design, landscaping, and screening. The proposed improvements will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Ordinance 12-003 and the Land Development Code the request from CAW, LLC to defer the construction of a vehicular use area is hereby approved. The vehicular use area shall be constructed within two (2) years from the date of approval, subject to the following conditions: 1. Prior to the issuance of any zoning compliance the property owner shall install one handicap parking space in accordance with Section 7.06.02(B)(4) of the Land Development Code. 2. Prior to the issuance of any zoning compliance the property owner shall construct a handicap ramp in accordance with the Florida Building Code and permitted by the St. Lucie County Building Department. 3. All parking spaces designated as inventory/storage spaces shall not be located within 10 feet of the side and rear property line and 25 feet of the front property line. All parking spaces designated as inventory/storage spaces shall be separated from all other parking spaces by a minimum 10 foot wide landscape divider median. 4. Prior to any development or construction, construction plans for the vehicular use area shall be submitted for review and approval by the County's Public Works Department Engineering, Water Quality Divisions, and Planning and Development Services Department Planning Division. No clearing or other site work shall commence until after constructible engineering plans have been approved. As of this date of issuance of this Administrative Order, no constructible site development plans have been submitted for review. 5. All other applicable state or federal permits must be obtained before commencement of construction. B. The property on which this deferral is being granted is located at:: Address: 920 Angle Road, Fort Pierce Parcel ID: 2406-414-0002-000/7 C. The developer is advised as part of this approval for CAW, LLC, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, WDA 720154881 July 15, 2015 PDS15-019 Page 2 of 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. This deferral granted by this Administrative Order shall expire on July 15, 2017. E. This Order shall be recorded in the Public Records of St. Lucie County.
