WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request to allow the manufacturing of Cured in Place Pipe as a permitted use in the IL zoning district and the request to defer the paving and drainage improvements to the vehicular use area in accordance with Ordinance 12-003 and the provisions of the Land Development Code and made the following determinations: Use Determination 1. Ferra Tex, Inc. is requesting a use determination to allow the manufacturing of Cured in Place Pipe (CIPP) as a permitted use in the IL (Industrial, Light) zoning district. 2. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code and has adopted amendments to the Land Development Code through certain ordinances. 3. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to make the determination after full analysis of all potential impacts that a proposed use is in compliance with the provisions of the Land Development Code and the St. Lucie County Comprehensive Plan. 4. The determination to allow the manufacturing of CIPP as a permitted use within the IL (Industrial, Light) zoning district is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan, the Land Development Code and Ordinance 12- 003, is in the best interest of the economic development, safety and public welfare of the citizens of St. Lucie County, Florida. 5. The proposed amendment will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare within the IL (Industrial, Light) zoning district. 6. Planning & Development Services Department, Planning Division staff has performed a detailed analysis of the request and determined the proposed use to be consistent with the St. Lucie County Land Development Code. The proposed use will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 8. All reasonable steps have been taken to minimize any adverse effect of the proposed use on the immediate vicinity through building design, site design, landscaping, and screening. 9. The proposed use will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. Paving Deferral 10. Ferra Tex, Inc. is requesting a one (1) year deferment to construct improvements for an all- weather surface vehicular use are in accordance with Ordinance 12-003 and the provisions of the Land Development Code Section 7.06.02(B)(3) Off -Street Parking and Loading for property located at 15838 Orange Avenue. 11. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida adopted Ordinance 12-003 granting Planning and Development Services Director the authority to allow for certain on-site improvements, including the construction of a vehicular use are to be deferred to a future date. 12. This Waiver, Deferral and Alternative approval will permit the issuance of zoning compliances to Ferra Tex, Inc. at 15838 Orange Avenue subject to compliance with Section 7.06.02(8)(4) ADA Accessibility of the Land Development Code. 13. The Waiver, Deferral, and Alternative Committee reviewed the request and Planning Staff has performed an analysis of the request to allow the deferral of improvements to the a vehicular use area is found in the Planning and Development Services Department Memorandum entitled Ferra Tex, Inc. 15838 Orange Avenue Use Determination and Paving Deferral dated July 24, 2015. NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services Director of St. Lucie County, Florida: Use Determination A. Pursuant to Ordinance 12-003 and the Land Development Code the manufacturing of Cured in Place Pipe (CIPP) has been determined to be consistent with similar permitted uses in the IL (Industrial, Light) zoning district, and, as such, is determined to be a permitted use in this zoning district. B. C. This Order shall only constitute approval of the manufacturing of Cured in Place Pipe (CIPP) as a permitted use be applicable in the IL (Industrial, Light) zoning district of the unincorporated area of St. Lucie County. Paving Deferral D. Pursuant to Ordinance 12-003 and the Land Development Code the request from Ferra Tex, Inc. to defer the improvements to the vehicular use area is hereby approved. The vehicular use area shall be constructed within one (1) year of from the date of approval, subject to the following conditions: The Environmental Resources Department (ERD) staff conducted a landscape inspection and determined that the property owner can meet the majority of their landscaping requirements by maintaining and preserving the existing vegetation onsite. ERD staff did determine that additional hedge material needed to be planted along the fence line on Boyd Road in order to fill in an existing gap. The new plant material shall be installed within 60 days of WDA approval. ERD will work with the property owner regarding the types of vegetation that can be used and the location of the plantings. Prior to any development or construction, construction plans for the vehicular use area shall be submitted for review and approval by the County's Public Works Department Engineering, Water Quality Divisions, and Planning and Development Services Department Planning Division. No clearing or other site work shall commence until after constructible engineering plans have been approved. As of this date of issuance of this Administrative Order, no constructible site development plans have been submitted for review. 3. Prior to the issuance of any zoning compliance the property owner shall install one handicap parking space in accordance with Section 7.06.02(B)(4) of the Land Development Code. E. The property on which this deferral is being granted is located at: Address: 15838 Orange Avenue, Fort Pierce Parcel I D# 2212-500-0003-000/3 F. The applicant is advised as part of this approval for Ferra Tex, Inc. including any successors in interest, , the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. WDA 420154857 July 27, 2015 PDS 15-024 Page 3 of 4 Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. G This deferral granted by this Administrative Order shall expire on July 27, 2016. H. This order shall be recorded in the Public Records of St. Lucie County.
