5 ST. LUCIE COUNTY GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO
6 MAJOR SITE PLAN KNOWN AS HUTCHINSON ISLAND CLUB CONDOMINIUM

8 WHEREAS, the St. Lucie County Planning & Development Services Director has reviewed the
9 request for a Minor Adjustment to Major Site Plan submitted by C. Calvert Montgomery and
10 Associates, Inc. on behalf of Hutchinson Island Club, Inc. and made the following determinations:

12 1. C. Calvert Montgomery and Associates, Inc. on behalf of Hutchinson Island Club, Inc.
13 requested a Minor Adjustment to Major Site Plan to provide handicap parking upgrades and
14 modify the existing drive aisles to accommodate circulation through an approximately 928
15 s.f. porte cochere to be constructed. The subject 5.11 acre property is located on South
16 Hutchinson Island (10410 South Ocean Drive) and is located in the Hutchinson Island
17 Zoning Overlay — Zone A. The underlying zoning is HIRD, Hutchinson Island Residential
18 District and the future land use is RM (Residential Medium — 9 du/acre). Water and
19 wastewater service is provided by the St. Lucie County Utilities.

21 2. On December 4, 1979, the Board of County Commissioners granted Site Plan approval for a
22 residential condominium project consisting of 92 dwelling units known as Hutchinson Island
23 Club Condominium.

25 3. On July 15, 1980, Minor Site Plan Adjustment approval was granted to re -locate the main
26 entrance, and identify locations for a swimming pool, lift station, and sewage treatment plant
2 � on the subject property.

29 4. On May 9, 2000, Minor Site Plan Adjustment approval was granted to convert 24 off-street
30 parking spaces to garage spaces on the north side of the property.

32 5. The Development Review Committee has reviewed the Minor Site Plan for the proposed
33 project pursuant to Section 11.02.03 and found it to meet technical requirements of Section
34 11.02.07 of the Land Development Code and to be consistent with the general purpose,
35 goals, objectives, and standards of the St. Lucie County Comprehensive Plan.

37 6. Planning staff has performed a detailed analysis of the project and determined it to be
38 consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The
39 analysis is found in the Planning and Development Services Department memorandum
40 entitled Hutchinson Island Club Condominium Minor Adjustment to Major Site Plan (SPMN
41 320154851) dated September 3, 2015.

43 7. The project will not have an undue adverse effect on adjacent property, the character of the
44 neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public
45 health, safety, and general welfare.

4 7 8. All reasonable steps have been taken to minimize any adverse effect of the proposed project
48 on the immediate vicinity through building design, site design, landscaping, and screening.

9. The project will be constructed, arranged, and operated so as not to interfere with the
development and use of neighboring property, in accordance with applicable district
regulations.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St.
Lucie County, Florida
A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the Minor
Adjustment to Major Site Plan known as Hutchinson Island Club Condominium is hereby
approved as shown on the Minor Adjustment to Major Site Plan drawings prepared by C.
Calvert Montgomery and Associates, Inc. dated March 17, 2015 and date stamped by the St.
Lucie County Planning & Development Services Department on September 2, 2015 for the
property described in Paragraph B subject to the following conditions:
1) The issuance of County development permit does not in any way create any rights on
the part of the applicant to obtain a permit from a state or federal agency and does not
create any liability on the part of the County if the applicant fails to obtain requisite
approvals or fulfill the obligations imposed by a state or federal agency or undertakes
actions that result in a violation of state or federal law.
2) All other applicable state or federal permits must be obtained before commencement of
the development.
B. The property on which this Minor Adjustment to Major Site Plan approval is being granted is
described as follows:
SITE LEGAL DESCRIPTION:
A parcel of land in Government Lots 1 and 4, Section 11, Township 37 South, Range 41
East, St. Lucie County, Florida bounded on the East by the shoreline of the Atlantic Ocean
and the West by the East Right-of-way of State Road A1A and being more particularly
described as follows:
From the Northwest corner of said Government Lot 1 and the Northeast corner of
Government Lot 2 as shown on the F.E. Engler Survey Plat of the North 605.23 feet of Lots
1 and 2, Section 11 and the South one-half of Lot 5, Section 2, Township 37 South, Range
41 East, Plat Book 7, Page 13, of the Public Records of St. Lucie County, Florida; thence
South 0°20'51" East along the line common to said Lots 1 and 2 a distance of 604.44 feet to
the South line of said F.E. Engler Survey Plat; thence South 0000'51" East a distance of
296.35 feet to an old 4" x 4' concrete monument; thence North 89057'39" East a distance of
242.64 feet to the East Right -of -Way of State Road Al A; thence South 23045'41 "East along
said Right-of-way Line a distance of 54.61 feet to the Point of Beginning.
Thence continue South 23045'41" East a distance of 440.51 feet; thence North 89153'39"
East a distance of 538.64 feet to the shoreline of the Atlantic Ocean; thence North 20°18'51"
West along said shoreline a distance of 429.27 feet; thence South 89057'39" West a
distance of 567.12 feet to the Point of Beginning.
Subject to Easements over, on and under the above described property for utility purposes.

C. The approvals granted by this administrative order shall expire on September 8, 2016 unless
building permits are issued or an extension is granted in accordance with the provisions of
Section 11.02.06 of the St. Lucie County Land Development Code.
D. The developer is advised as part of this Minor Site Adjustment to Major Site Plan approval
for Hutchinson Island Club Condominium, including any successors in interest, the
developer shall obtain all applicable development permits and construction authorizations
from the appropriate State and Federal and local regulatory agencies including, but not
limited to, the United States Army Corps of Engineers, the Florida Department of
Environmental Protection, and South Florida Water Management District, and the St. Lucie
County Environmental Resources and Building Departments prior to the commencement of
any development activities on the property described in Part B. Issuance of this permit by
the County does not in any way create any rights on the part of the developer to obtain a
permit from a state or federal agency and does not create any liability on the part of the
County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill
the obligations imposed by a state or federal agency or undertake actions that may result in
a violation of state or federal law.
E. A copy of this Order shall be attached to the site plan drawings described in Part A, which
plan shall be placed on file with the St. Lucie County Planning & Development Services
Director.
F. This order shall be recorded in the Public Records of St. Lucie County.
