LUCIE COUNTY. a W F H � WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, bas, o c on the testimony and evidence, including but not limited to the staff report, has ma( 11 the following determinations: W N z-W �Ooac 1. Harbor Ridge Country Club, Inc. presented a petition for a Major Adjustment 2 Q;a Final Planned Unit Development (PUD) Site Plan known as Harbour Rid( W t�i z Yacht and Country Club PUD located at 13400 Gilson Road, as depicted on tt Wo attached map as Exhibit "A" and described in Part "A" below. The subject +/- g N�o W acre property is zoned PUD, Planned Unit Development and has a future lar use designation of RE (Residential, Estate — 1 du/acre). The Site Plan Adjustment results in the removal of the existing buildings that total approximately 8,200 s.f. and four (4) existing tennis courts on the subject property, the construction of a 18,566 s.f. LifeStyle Center, a 1,290 s.f. real estate office, a 900 s.f. maintenance building, a gazebo and a new outdoor swimming pool. 2. On January 12, 1982, the Board of County Commissioners adopted Resolution No. 82-6 authorizing a zoning change from AR-1 (Agricultural, Residential — 1) to PUD (Planned Unit Development) for approximately 885 acres. 3. On December 21, 1982, the Board of County Commissioners adopted Resolution No. 82-174 authorizing a Development of Regional Impact (DRI) for Harbour Ridge Yacht and Country Club consisting of 814 dwelling units and associated recreational amenities. 4. The Land Development Coordinator granted an Administrative Site Plan Adjustment approval for a building addition to the Tennis Center. 5. The St. Lucie County Development Review Committee has reviewed the petition for a Major Adjustment to Final PUD Site Plan for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part A of this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: October 6, 2015 Resolution No. 2015-186 File No.: SPMJ 520154868 Page 1 A. Pursuant to Land Development Code, Section 11.02.05, the Major Adjustment to Final PUD Site Plan known as Harbour Ridge Yacht and Country Club PUD is hereby approved as shown on the site plan drawings for the project prepared by Lucido and Associates, dated July 20, 2015, 2015 and date stamped received by the Planning and Development Services Department, Planning Division on October 14, 2015 subject to the following conditions: 1. Within 90 days after receiving site plan approval, the applicant shall execute an agreement to pay a fee-in-lieu of construction for sidewalks and remit to the County the required funds. The acceptable method of payment shall be a certified check payable to St. Lucie County. 2. Tennis court lighting shall not exceed a maximum height of 25 feet and footcandle readings shall not exceed a reading of 0.01 at all property lines. 3. Prior to issuance of a vegetation removal permit or exemption a detailed root pruning plan shall be submitted and approved by the Environmental Resources Department. Root pruning shall occur a minimum of three months prior to any construction activities within the affected area. 4. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 5. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which the Major Adjustment to Final PUD Site Plan is being granted is shown on a map in Exhibit "A" and described as follows: TRACT TC-1, HARBOUR RIDGE, PLAT NO. 2, AS RECORDED IN PLAT BOOK 24, PAGES 5, 5A THROUGH 5E, PUBLIC RECORDS OF S. LUCIE COUNTY, FLORIDA. Parcel Identification Number: 4425-701-0016-000-4 C. The approvals and authorizations granted by this Resolution expire on October 6, 2017 unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. D. The property owner, including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States October 6, 2015 Resolution No. 2015-186 File No.: SPMJ 520154868 Page 2 Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part A are an integral non-severable part of the site plan approval granted by this Resolution. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. F. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director.
