5 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
6 COUNTY AMENDING THE OFFICIAL ZONING ATLAS FOR A 11.93 ACRE (M.O.L.)
7 PARCEL OF LAND OWNED BY RUFFIN PROPERTIES, LLC, FROM HIRD (HUTCHINSON
8 ISLAND RESIDENTIAL DISTRICT) TO CR (COMMERCIAL RESORT).

10 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
11 testimony and evidence, including, but not limited to the staff report, has made the following
12 determinations:
13
14 1. A petition of Ruffin Properties LLC, to amend the Official Zoning Atlas for a 11.93 acre
15 (MOL) parcel from HIRD (Hutchinson Island Residential District) to CR (Commercial
16 Resort) and located on North Hutchinson Island within St. Lucie County, Florida;
17
18 2. St. Lucie County Planning and Development Services staff has performed the required
19 land use analysis for this application, which can be found in the Planning and
20 Development Services memorandum dated November 3, 2015, entitled "Commercial
21 Resort, Ruffin Properties, LLC - Proposed Amendment to the Official Zoning Atlas to
22 CR (Commercial Resort);"

24 3. On July 16, 2015, the St. Lucie County Planning and Zoning Commission held a
25 public hearing on the petition, of which due notice was published in the St. Lucie News
26 Tribune and recommended that the Board of County Commissioners approve the
27 change in zoning to CR (Commercial Resort);

29 4. On October 6, 2015, the Board of County Commissioners of St. Lucie County, Florida,
30 held a public hearing, of which due notice was published in the St. Lucie News Tribune
31 and continued the item to November 3, 2015;

33 5. On November 3, 2015, the Board of County Commissioners of St. Lucie County,
34 Florida, held a public hearing, of which due notice was published in the St. Lucie News
35 Tribune;

37 6. The proposed change in zoning satisfies the Standards of Review for granting a zoning
38 change per Section 11.06.03 of the St. Lucie County Land Development Code as
39 outlined in the Planning and Development Services memorandum dated November 3,
40 2015 and is consistent with the goals, objectives, and policies of the St. Lucie County
41 Comprehensive Plan; and

43 7. The proposed change in zoning is compatible with the existing land use and zoning in
44 the surrounding area and is in the best interest of the health, safety and public welfare
45 of the citizens St. Lucie County.

2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
3 County, Florida:

5 A. The recitals set forth above are true and correct and are expressly incorporated here
6 within.

8 B. The Official Zoning Atlas is hereby amended from HIRD (Hutchinson Island Residential
9 District) to CR (Commercial Resort) for an 11.93 acre (MOL) parcel located on North
10 Hutchinson Island and depicted in Exhibit A.

12 B. The Planning and Development Services Director is hereby authorized and directed to
13 cause the change to be made on the Official Zoning Atlas of St. Lucie County, Florida,
14 and to make notation of reference to the date of adoption of this Resolution.

16 C. This Resolution shall be recorded in the Public Records.
