4 AN ORDER GRANTING A MINOR ADJUSTMENT TO THE
5 PREVIOUSLY APPROVED PLANNED UNIT DEVELOPMENT (PUD)
6 SITE PLAN FOR THE PROJECT KNOWN AS LEGACY GOLF AND
7 TENNIS CLUB (RESERVE DRI)

9 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
10 request for a Minor Adjustment to the PUD Site Plan and reviewed the comments of the
11 Development Review Committee and has made the following determinations:
12
13 1. Tyringham Ridge, Inc. requested a MinorAdjustment to the PUD Site Plan to construct the
14 addition of a miniature golf course and a patio deck to the rear of the existing clubhouse
15 for the Legacy Golf and Tennis Club located at 9000 Clubhouse Drive.

17 2. On December 20, 1988, the Board adopted Resolution No. 88-357, effective December
18 28, 1988, granting development order approval to the Reserve and that has been
19 amended several times through to Resolution No. 12-004.

21 3. The Development Review Committee has reviewed the Minor Adjustment to the proposed
22 project pursuant to the Land Development Code (LDC), Section 11.02.05(E) and found it
23 to meet technical requirements and to be consistent with the general purpose, goals,
24 objectives, and standards of the St. Lucie County Comprehensive Plan. Planning staff has
25 performed a detailed analysis of the project and found it to be consistent with the St. Lucie
26 County Land Development Code and Comprehensive Plan. The analysis is found in the
27 Planning and Development Services memorandum titled Legacy Golf and Tennis Club
28 MinorAdjustment to the PUD, dated December 18, 2015.

30 4. The project will not have an undue adverse effect on adjacent property, the character of
31 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the
32 public health, safety, and general welfare.

34 5. All reasonable steps have been taken to minimize any adverse effect of the proposed
35 project on the immediate surroundings through building design, site design, landscaping
36 and screening.

38 NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St.
39 Lucie County, Florida:

41 A. Pursuant to Section 11.02.05(E) of the St. Lucie County Land Development Code, the
42 MinorAdjustment is hereby approved as shown on the drawing dated September 21, 2015
43 prepared by The Velcon Group, Inc., date stamped by the Planning & Development
44 Services Department on November 23, 2015 for the property described in Paragraph B
45 below, subject to the following conditions:

47 1. All site lighting for the miniature golf area shall comply with Land Development
48 Code Section 7.09.04(K) General Landscaping Requirements — Off Street Site
49 Lighting Requirements ad General Design Standards.

2 2. Prior to the issuance of a Vegetation Removal Permit, the applicant shall install silt
3 fencing or another visual barricade between the proposed miniature golf course and
4 the upland area to the west.

6 3. The issuance of County development permit does not in anyway create any rights
7 on the part.of the applicant to obtain a permit from a state or federal agency and does
8 not create any liability on the part of the County if the applicant fails to obtain requisite
9 approvals or fulfill the obligations imposed by a state or federal agency or undertakes
10 actions that result in a violation of state or federal law.

12 4. All other applicable state or federal permits must be obtained before
13 commencement of the development.

Corps of Engineers, the Florida Department of Environmental Protection, and South
Florida Water Management District, and the St. Lucie County Environmental Resources
and Building Departments prior to the commencement of any development activities on the
property described in Part B. Issuance of this permit by the County does not in any way
create any rights on the part of the developer to obtain a permit from a state or federal
agency and does not create any liability on the part of the County for issuance of this
permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed
by a state or federal agency or undertake actions that may result in a violation of state or
federal law.
E. A copy of this Minor Adjustment to Legacy Golf and Tennis Club Site Plan shall be placed
on file with the St. Lucie County Planning and Development Services Director.
