Holiday Out HOA requested a Minor Adjustment to the Major Site Plan for Holiday Out at 15 St. Lucie Recreation Area to construct the addition of pickle ball courts located at 10820 16 South Ocean Drive within the HI RD (Hutchinson Island Residential District) zoning district. 17 18 2. On September 12, 1967 Holiday Out in America at St. Lucie was platted as recreational 19 campsite condominium. 20 21 3. On February 20, 1992 the County amended Land Development Code Section 7.10.16 — 22 Recreational Vehicle Parks to permit recreational vehicles, travel trailers, single family 23 residences and mobile homes within recreational vehicle parks on Hutchinson Island. 24 25 4. The Development Review Committee has reviewed the Minor Adjustment to the proposed 26 project pursuant to the Land Development Code (LDC), Section 11.02.05(E) and found it 27 to meet technical requirements and to be consistent with the general purpose, goals, 28 objectives, and standards of the St. Lucie County Comprehensive Plan. Planning staff has 29 performed a detailed analysis of the project and found it to be consistent with the St. Lucie 30 County Land Development Code and Comprehensive Plan. The analysis is found in the 31 Planning and Development Services memorandum titled Holiday Out Pickle Ball Courts, 32 dated February 2, 2016. 33 34 5. The project will not have an undue adverse effect on adjacent property, the character of 35 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the 36 public health, safety, and general welfare. 37 38 6. All reasonable steps have been taken to minimize any adverse effect of the proposed 39 project on the immediate surroundings through building design, site design, landscaping 40 and screening. 41 42 NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. 43 Lucie County, Florida: 44 45 A. Pursuant to Section 11.02.04(C) of the St. Lucie County Land Development Code, the 46 Minor Adjustment is hereby approved as shown on the drawing prepared by Stephen J. 47 Brown, Inc., date stamped by the Planning & Development Services Department on 48 December 21, 2015 for the property described in Paragraph B below, subject to the 49 following conditions: File No. SPMN 1220154966 PDS 16-008 February 2, 2016 Page 1 of 3 1 2 1) Within 90 days of site plan approval all invasive exotic vegetation located within the 3 property boundary shall be removed (Land Development Code Section 7.09.05). 4 5 2) The issuance of County development permit does not in any way create any rights on 6 the part of the applicant to obtain a permit from a state or federal agency and does not 7 create any liability on the part of the County if the applicant fails to obtain requisite 8 approvals or fulfill the obligations imposed by a state or federal agency or undertakes 9 actions that result in a violation of state or federal law. 10 11 3) All other applicable state or federal permits must be obtained before commencement of 12 the development. 13 14 B. The property on which this Minor Adjustment to the Major Site Plan for Holiday Out at St. 15 Lucie Plan Recreation Area approval is being granted is described as follows: 16 17 HOLIDAY OUT AT ST. LUCIE BLK A LOT 1 AND EQUAL PRO -RATA, INTEREST IN 18 COMMON ELEMENTS, MORE SPECIFICALLY DESCRIBED AS THAT PART OF 19 PARCEL 1, AS SHOWN ON THE RECORDED PLAT OF HOLIDAY OUT IN AMERICA 20 AT ST LUCIE, INC., AS RECRDED IN PLAT BOOK 14 PAGE 28, PUBLIC RECORDS OF 21 ST LUCIE COUNTY FLORIDA, SPECIFICALLY, PARCEL 1 22 23 PARCEL 1 -START AT THE SOUTHWEST CORNER OF SECTION 12, TOWNSHIP 37 24 SOUTH, RANGE 41 EAST, THENCE RUN N89D-55'-14"E ALONG THE SOUTH LINE OF 25 SAID SECTION 12 A DISTANCE OF 774.41 FEET TO THE POINT OF INTERSECTION 26 WITH THE CENTERLINE OF STATE ROAD A1ATHENCE RUN N23D-49'31"W ALONG 27 SAID ROAD CENTERLINE A DISTANCE OF 1549.41 FEET TO THE POINT OF 28 BEGINNING, 29 30 THENCE CONTINUE TO RUN N 23D -49'31"W ALONG SAID CENTERLINE A 31 DISTANCE OF 600 FEET THENCE RUN N89D56'22"E A DISTANCE OF 545.93 FEET 32 MORE OR LESS TO THE WATERS OF THE ATLANTIC OCEAN, THENCE MEANDER 33 SAID WATERS SOUTHEASTERLY 600 FEET MORE OR LESS TO THE POINT OF 34 INTERSECTION WITH A LINE THAT BEARS N 89D -56'22"E FROM THE POINT OF 35 BEGINNING, THENCE RUN S89D-56'22"W ALONG THE LASTLY SAID LINE A 36 DISTANCE OF 545.93 FEET, MORE OR LESS, TO THE POINT OF BEGINNING, LESS 37 THE RIGHT OF WAY OF STATE ROAD A -1-A. 38 39 Parcel I D#4511-501-0001-000/6 40 41 C. This Minor Adjustment to Holiday Out at St. Lucie Recreation Area shall expire on January 42 26, 2017 unless a building permit is issued or an extension is granted in accordance with 43 the provisions of Land Development Code, Section 11.02.06. 44 45 D. The developer is advised as part of this Minor Adjustment approval for Holiday Out HOA. 46 including any successors in interest, the developer shall obtain all applicable development 47 permits and construction authorizations from the appropriate state, federal and local 48 regulatory agencies including, but not limited to, the United States Army Corps of 49 Engineers, the Florida Department of Environmental Protection, South Florida Water 50 Management District, and the St. Lucie County Environmental Resources and Building 51 Departments prior to the commencement of any development activities on the property File No. SPMN 1220154966 PDS 16-008 February 2, 2016 Page 2 of 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 described in Part B. Issuance of this permit by the County does not in anyway create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Minor Adjustment to Holiday Out at St. Lucie Recreation Area shall be placed on file with the St. Lucie County Planning and Development Services Director. F.
