HomeMy WebLinkAboutPDS-16-018 - Savanna Club On-Site Sales and Leasing Office1PDS 16-018 2 SPMN 220154963 3 4 AN ORDER GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO A 5 FINAL PLANNED UNIT DEVELOPMENT (PUD) SITE PLAN KNOWN AS 6 SAVANNA CLUB ON-SITE SALES AND LEASING OFFICE. 7 8 WHEREAS, the St. Lucie County Planning and Development Services Director has 9 reviewed the request for Minor Adjustment to Final Planned Unit Development (PUD) 10 Site Plan submitted by Sun Communities, Inc. and the comments of the St. Lucie 11 County Development Review Committee on this application, and has made the 12 following determinations. 13 14 1. Sun Communities, Inc. requested a Minor Adjustment to the Final Planned Unit 15 Development (PUD) Site Plan for the construction of a 1,760 square foot sales 16 and leasing office. The subject 0.29 acre property is zoned PUD (Planned Unit 17 Development) and is located at 3412-3416 Crabapple Drive, on the property 18 described in Part B below. 19 20 2. On November 18, 1980, the Board of County Commissioners approved the 21 Preliminary Planned Unit Development plans for the project known as Savanna 22 Club, Planned Unit Development. 23 24 3. On April 27, 1982, the Board of County Commissioners, through Resolution No. 25 82-58 granted Final Development Order approval to the Development of 26 Regional Impact known as Savanna Club consisting of 2,560 mobile homes with 27 a recreation complex. 28 29 4. On November 2, 1982, the Board of County Commissioners, through Resolution 30 No. 82-151, granted Final Planned Unit Development approval for the project 31 known as Savanna Club, Planned Unit Development. 32 33 5. The Development Review Committee has reviewed the Minor Adjustment to 34 Final PUD Site Plan and found it to meet the technical requirements of the St. 35 Lucie County Land Development Code and to be consistent with the St. Lucie 36 County Comprehensive Plan. 37 38 6. Planning staff has performed a detailed analysis of the project and determined 39 it to be consistent with the St. Lucie County Land Development Code and 40 Comprehensive Plan. The analysis is found in the Planning and Development 41 Services Department Memorandum entitled Savanna Club On -Site Sales and 42 Leasing Office — Minor Adjustment to Final PUD Site Plan dated April 1, 2016. The project will not have an undue adverse effect on adjacent property, the 2 character of the neighborhood, traffic conditions, parking, utility facilities, or 3 other matters affecting the public health, safety and general welfare. 4 5 8. All reasonable steps have been taken to minimize any adverse effect of the 6 proposed project on the immediate vicinity through building design, site design, 7 landscaping and screening. 8 9 9. The project will be constructed, arranged and operated so as not to interfere 10 with the development and use of neighboring property, in accordance with 11 applicable district regulations. 12 13 10. The applicant has applied for and received a Certificate of Capacity, a copy of 14 which is attached to this Order as Exhibit A, as required under Chapter V, St. 15 Lucie County Land Development Code.-. 16 17 NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services 18 Director of St. Lucie County, Florida: 19 20 A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code 21 (LDC), the Minor Adjustment to the Final Planned Unit Development Site Plan 22 for the project known as Savanna Club On -Site Sales and Leasing Office is 23 hereby approved as shown on the plan drawings for the project prepared by 24 Culpepper and Terpening, Inc. dated February 5, 2016 and date stamped 25 received by the St. Lucie County Planning and Development Services 26 Department on March 23, 2016 on the property described in Part B, subject to 27 the following conditions: 28 29 1. The hours of operation for the sales and leasing office shall be 8:00 a.m. 30 to 5:00 p.m., Monday through Saturday. 31 2. All real estate transactions at the sales and leasing office shall consist of 32 properties within the Savanna Club PUD. No exterior real estate sale 33 transaction shall be permitted. 34 3. There shall be no outdoor storage of equipment or materials on the 35 property, with the exception of garbage and recycling receptacles during 36 pick-up day(s). 37 4. All exterior lighting shall consist of wall mounted fixtures only. Footcandle 38 readings shall not exceed 0.01 foot candle readings at all property lines. 39 5. The exterior signage shall consist of one (1) monument (ground) sign as 40 depicted on the site plan. No other exterior signs shall be installed on 41 the property. The sales and leasing office building shall be constructed with similar design of the existing single family residences in the community, utilizing comparable exterior materials and colors. 7. Prior to the issuance of a Certificate of Occupancy, a bike rack shall be installed on the subject property, between the building and the 8 -foot wide sidewalk. 8. The issuance of a County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal .agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 9. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which the Minor Adjustment to the Final Planned Unit Development (PUD) Site Plan approval is being granted is described as follows: BEING ALL OF LOTS 1 AND 2, BLOCK 77, ACCORDING TO THE PLAT OF FAIRWAYS AT SAVANNA CLUB REPLAT NO. 1, AS RECORDED IN PLAT BOOK 57, PAGE 39 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.. PARCEL NUMBERS: 3424-800-0198-000-1 AND 3424-800-0199-000-8 C. The approvals granted by this administrative order shall expire on April 6, 2018 unless building permits are issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the 'St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Adjustment to Final Planned Unit Development Site Plan approval for Sun Communities, Inc. including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to; the United _States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the April 6, 2016 Page 3 PDS Order 16-018 1�/ 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 '25 26 27 28 29 30 31 32 33 34 �4 • obligations imposed- by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which shall be placed on file with the St. Lucie County Planning & Development Services Director. F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This order shall be recorded in the Public Records of St. Lucie County.
