AN ORDER GRANTING ADMINISTRATIVE RELIEF FROM THE ALL WEATHER
SURFACE PAVING REQUIREMENTS FOR THE BORDELLO MEDICAL OFFICE
LOCATED AT 4343 NORTH US HIGHWAY 1 IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Planning and Development Services Director of St. Lucie County,
Florida, based on the written request and staff report, has made the following
determinations:
Engineering Desi n and Construction Inc. petitioned for Administrative Relief
from the provisions of Section 7.06.028.3 of the 'St. Lucie County Land
Development Code to allow for the use of asphalt milling materials for a
proposed on-site parking area. The subject property is located at 4343 North US
Highway 1, Fort Pierce, Florida and depicted on the attached map as Exhibit "A".
2. The request for administrative relief has met the provisions for relief set forth in
LDC Section 7.06.03A. The applicant has provided a written request and analysis
that demonstrates the proposed relief is based upon conditions that are unique
and peculiar to the site conditions and will not affect surrounding property or the
safety of the onsite circulation pattern. The County Engineer has reviewed the
request for administrative relief from the all-weather parking surface
requirements and provided the Planning and Development Services a written
finding that the requests meets the standards of this section.
3. Planning and Development Services Department, Planning Division staff has
performed a detailed analysis of the request and determined it to be consistent
with the St. Lucie County Land Development Code. The analysis is found in the
Planning and Development Services Department Memorandum entitled Bordello
Medical office Administrative Relief dated April 18, 2016.
NOW, THEREFORE, BE IT ORDERED:
A. The petition of Engineering Design and Construction, Inc. for Administrative
Relief from the provisions of Section 7.06.02B.3, of the St. Lucie County Land
Development Code is hereby approved as depicted on the WDA site detail sheet
prepared by Engineering Design and Construction Inc., dated December 23,
2015 as revised through April 5, 2016 and date stamped received by the
PIanning Division on April 15, 2016. Said approval will allow the rear parking
area with 7 parking spaces to be surfaced with asphalt millings, subject to the
following conditions of approval:

1. Within 90 days of Waivers, Deferrals and Alternatives approval all Category I
invasive exotic species shall be removed from the site. Contact Environmental
Resources Department for an inspection once completed.
2. The issuance of County development permit does not in any way create any
rights on the part of the applicant to obtain a permit from a state or federal
agency and does not create any liability on the part of the County if the
applicant fails to obtain requisite approvals or fulfill the obligations imposed by
a state or federal agency or undertakes actions that result in a violation' of
state or federal law.
3.' All other applicable state or federal permits must be obtained before
commencement of the development.
B. The subject property is described as follows:
Parcel No. 1420-141-0903-000-8
The Southerly 286.34 feet, as measured along the Westerly right-of-way of U.S.
Highway No.1 (State Road No. 5), of the Easterly 324.20 . feet, as measured
along the Southerly line of the lands described in Official Records Book 545,
Page 1045 of the Public Records of St. Lucie County, Florida, less the Easterly
20.45 feet as measured along said Southerly line of Official Records Book 545,
Page 1045 of the Northerly 181.24 feet, as measured along the right-of-way of
said U.S. Highway No. 1 of the above described lands, of the lands described in
said: Official Records Book 545, Page 1045.
TOGETHER WITH:
A 30.00 foot wide easement for ingress and egress over and across the
Southerly 30.00 feet of the Easterly 20.00 feet of the Northerly 181.34 feet of the
Southerly 286.34 feet, the last two calls being measured along the right-of-way of
said U.S. Highway No. 1 of the lands described in said Official Records Book
545, Page 1045, of the Public Records of St. Lucie County, Florida.
C. The approvals and authorizations granted by this Order are granted to the
applicant for the purpose of obtaining construction authorizations or Zoning
Compliance from St. Lucie County.
D. An appeal of the Planning and Development Services Director's action may be
processed in accordance with Section 11.11.02 of the St. Lucie County Land
Development Code.
