5 A RESOLUTION DENYING A VARIANCE FOR
6 CERTAIN PROPERTY LOCATED AT 505 NETTLES BOULEVARD
7 IN ST. LUCIE COUNTY, FLORIDA

9 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and
10 evidence, including, but not limited to the staff report, has made the following determinations:

12 1. George R. and Joyce M. Voigt petitioned for a variance from the provisions of Section
13 7.10.16(Q)(1)(a), of the St. Lucie County Land Development Code to allow for the
14 replacement of an old mobile home unit with a new manufactured home which
15 encroaches a maximum of 2.5 feet into the minimum unobstructed side setback of 8 feet
16 required in Recreational Vehicle Parks located in the HIRD (Hutchinson Island
17 Residential District) Zoning District.

19 . 2. On May 25, 2016, this Board held a public hearing on the petition, after publishing a
20 notice of such hearing in the newspaper, installing a sign on the property and notifying
21 by mail all owners of property within 500 feet of the subject property.

23 3. After consideration of the testimony presented during the public hearing, including staff
24 comments, exhibits, and the standards of review for granting variances set out in Section
25 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made
26 the following determinations:

28 The requested variance does not meet the standards of review as set forth in Section
29 10.01.02, St. Lucie County Land Development Code, and is in conflict with the goals,
30 objectives, and policies of the St. Lucie County Comprehensive Plan, because:

32 A. The granting of the requested variance would create a safety hazard and otherwise
33 injure adjacent property owners or improvements in the area in which the subject
34 property is located,
35
36 B. Fifty-six property owners within 500 feet of the subject property were not in favor of
37 the requested variance;

39 C. The requested variance does not meet the general spirit and intent of the St. Lucie
40 County Land Development Code and the St. Lucie County Comprehensive Plan.

42 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
43 Florida:

45 A. Petition of George R. and Joyce M. Voigt, for a Variance from the provisions of

2 evidence, for the property depicted on the attached map as Exhibit "A" and
3 described as follows:

5 Lot 505, Section II, Outdoor Resorts at Nettles Island, (now known as Nettles
6 Island, Inc.) according to the Plat thereof, recorded in Plat Book 16, Pages 1, 1A
7 through U and according to the Declaration of Condominium recorded in Official
8 Record Book 186, Page 2720 and amendments thereto of the Public Records of
9 St. Lucie County, FL

11 B. An appeal of the Board of Adjustment's action may be processed in accordance with
12 Section 10.01.07 of the St. Lucie County Land Development Code.
