LUCIE COUNTY, FLORIDA 7 8 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and 9 evidence, including, but not limited to the staff report, has made the following determinations: 10 11 1. Petition of Fort Pierce No. 1, LLC for a variance to construct an approximately 270 12 square foot railcar shaker A -frame to encroach 27 feet 2 inches into the required 13 minimum 30 foot side yard setback and 30 feet 10 inches into the required minimum 14 front yard setback. The subject 9.22 acre property is located at 5720 Environment Drive 15 in the IH, Industrial, Heavy zoning district. 16 17 2. On May 25, 2016 this Board held a public hearing on the petition, after publishing a 18 notice of such hearing, installing a sign on property and notifying by mail all owners of 19 property within 500 feet of the subject property. 20 21 3. After consideration of the testimony presented during the public hearing, including staff 22 comments, exhibits, and the standards of review for granting variances set out in.Section 23 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made 24 the following determinations: 25 26 The requested variance meets the standards of review as set forth in Section 10.01.02, 27 St. Lucie County Land Development Code and is not in conflict with the goals, 28 objectives, and policies of the St. Lucie County Comprehensive Plan, because 29 30 a) There were no oral or written objections made from the public in regards to the 31 variance; 32 33 b) The variance is the minimum variance that will make possible the reasonable use 34 of land, 35 36 c) Any modifications to the existing railroad spur in order to comply with the 37 minimum building setback may result in a hardship for the owner; and 38 39 d) The variance does not impair or otherwise injure other property or improvements 40 in the area in which the subject property is located 41 42 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, 43 Florida: 44 45 A. LUCIE COUNTY, FLORIDA. ADDRESS: 5720 ENVIORNMENT DRIVE, FORT PIERCE, FL PARCEL IDENTIFICATION NO: 3301-501-0003-000-2 B. Based on the evidence presented, this variance is approved. C. An appeal from the Board of Adjustment's action may be processed in accordance with Section 10.01.07, of the St. Lucie County Land Development Code.
