LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS GRANTING SOVRAN ACQUISITION LTD PARTNERSHIP A MAJOR ADJUSTMENT TO A MAJOR SITE PLAN PROJECT TO BE KNOWN AS UNCLE BOB'S SELF STORAGE IN THE CG (COMMERCIAL, GENERAL) ZONING DISTRICT FOR PROPERTY LOCATED AT 8531 SOUTH US HIGHWAY 1 IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Sovran Acquisition Ltd Partnership presented a petition for a Major Adjustment to a Major Site Plan project to add one acre of land and expand the total building square footage by 29,037 square feet and change the project name (FKA Store -it Mini Storage) of the household goods self storage facility in the CG (Commercial, General) Zoning District located at 8531 South US Highway 1, approximately '/4 mile north of Savanna Club Boulevard as described in Part B below and depicted in Exhibit "A". 2. On May 13, 1986, the Board of County Commissioners approved Resolution 86-94 granting site plan approval for a project known as Stor-it Mini -storage located at 8531 South US Highway 1. 3. On October 7, 1997, through Ordinance 97-009, the St. Lucie County Board of County Commissioners approved the transferal of warehousing and storage services — household goods warehousing and storage from the permitted uses to the conditional uses in the CG (Commercial, General) Zoning, classifying the existing storage facility as a conditional use. A concurrent application has been submitted for an adjustment to the existing conditional use. 4. The Development Review Committee has reviewed the proposed site plan for the project and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. 5. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. The applicant has applied for and received a Certificate of Capacity, a 3 copy of which is attached to this order as Exhibit A, as required by 4 Chapter V, St. Lucie County Land Development Code. 5 6 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. 7 Lucie County, Florida: 8 9 A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, 10 the proposed Major Adjustment to the Major Site Plan project to be known as Uncle 11 Bob's Self Storage Facility (FKA Stor-it Mini Storage), is hereby approved as shown on 12 the site plan drawings for the project prepared by Schulke, Bittle & Stoddard, L.L.C., as 13 revised on May 24, 2016 and date stamped received by the St. Lucie County Planning 14 Division on June 6, 2016, subject to the following conditions: 15 16 1. The terms and conditions set forth in Resolution 2016-104, granting 17 conditional use permit approval for the Uncle Bob's Self Storage, are 18 incorporated herein, and shall remain in full force and effect, unless 19 amended consistent with Land Development Code provisions. 20 2. Prior to the issuance of any building permits or construction authorizations 21 the applicant shall provide signed and sealed drawings for review and 22 approval by the St. Lucie County Engineering Division. 23 3. Prior to the issuance of any building permits the St. Lucie County Fire 24 District shall review and approve the project plans. 25 4. Prior to the issuance of a Vegetation Removal Permit or Exemption, a 26 gopher tortoise survey per Florida Fish and Wildlife Conservation 27 Commission protocol, shall be provided to the Environmental Resources 28 Department. Should the survey show impacts to gopher tortoises a Florida 29 Fish and Wildlife Conservation Commission permit shall be required. 30 5. Prior to the issuance of Building Permit the developers, their successor or 31 assigns, shall satisfy the remaining 632 inches in diameter at breast height 32 (DBH) in tree mitigation, by paying into the St. Lucie County Tree 33 Mitigation Fund at a cost of $200 per inch DBH ($126,400.00). 34 6. Within 90 days of the Major Adjustment to the Site Plan approval, all 35 invasive exotic vegetation located within the property boundary shall be 36 removed. 37 7. The issuance of County development permit does not in any way create 38 any rights on the part of the applicant to obtain a permit from a state or 39 federal agency and does not create any liability on the part of the County if 40 the applicant fails to obtain requisite approvals or fulfill the obligations 41 imposed by a state or federal agency or undertakes actions that result in a 42 violation of state or federal law. 43 8. All other applicable state or federal permits must be obtained before 44 commencement of the development. 45 9. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void.
