SMITH, CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE # 421 671 7 08104/2016 09:23:09 AM OR BOOK 3897 PAGE 2614 - 2616 Doc Type: ORD RECORDING: $27.00 PDS ORDER FILE NO.: SPMN 520165022 AN ORDER OF THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR GRANTING A MINOR ADJUSTMENT TO THE OAKBRIDGE SUBDIVISION MINOR SITE -PLAN WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a MinorAdjustment to the Minor Site Plan for Oakbridge Subdivision and reviewed the comments of the Development Review Committee and has made the following determinations: Association of Oakbridge Homeowners, Inc. requested a Minor Adjustment to the Minor Site Plan for Oakbridge Subdivision to construct a dry hydrant utilizing water from the existing interconnected lakes for firefighting purposes and to remove the condition of approval requirement of fire sprinkling of each residence. 2. On April 19, 2007 the Planning and Development Services Director granted approval to the Oakbridge Subdivision Minor Site Plan through GM Order 07-005 that included a condition of approval for the provision of "All single family homes will be required to install fire sprinklers as a fire protection system. " 3. The petitioner, Association of Oakbridge Homeowners, Inc., was granted approval by the St. Lucie County Fire District to remove the condition of approval and be permitted to construct a dry hydrant utilizing water from the existing interconnected lakes for firefighting purposes. 4. The Development Review Committee has reviewed the Minor Adjustment to the proposed project pursuant to the Land Development Code (LDC), Section 11.02.03 and found it to meet technical requirements and to be consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan. Planning staff has performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services memorandum titled Oakbridge MinorAdjustment to Minor Site Plan, dated July 18, 2016. 5. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic'conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate surroundings through building design, site design, landscaping and screening. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.02.03(C) of the St. Lucie County Land Development Code, this. Minor Adjustment is hereby approved as shown on the drawing prepared by M. Randall Rodgers, P.E., dated July 6, 2016 and date stamped by the Planning & Development File No. SPMN 520165022 PDS 16-036 July 18, 2016 Page 1 of 3 1 Services Department on July 7, 2016 for the property described in Paragraph B below, 2 subject to the following conditions: 3 4 1. Prior to issuance of a Certificate of Occupancy for the first residential building permit, 36 an upland buffer and littoral planting plan for the stormwater pond shall be provided 37 and installed consistent with Land Development Code 6.02.03.F and Comprehensive 38 Plan Policy 6.1.2.5. If natural recruitment of the littoral zone continues to occur and a 39 functional littoral zone establishes, the littoral planting requirement may be waived by 40 the Environmental Resources Director or designee. 41 42 7. The issuance of County development. permit does not in any way create any rights on 43 the part of the applicant to obtain a permit from a state or federal agency and does not 44 create any liability on the part of the County if the applicant fails to obtain requisite 45 approvals or fulfill the obligations imposed by a state or federal agency or undertakes 46 actions that result in a violation of state or federal law. 47 48 8. All other applicable state or federal permits must be obtained before commencement of 49 the development. 50 51 B. This MinorAdjustment to Oakbridge Subdivision shall expire on July 18, 2018, unless the dry hydrant is approved by the Fire District or an extension is granted in accordance with the provisions of Land Development Code, Section 11.02.06. D. The Association of Oakbridge Homeowners, Inc. is advised as part of this Minor Adjustment approval for Oakbridge Subdivision including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state, federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South. Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Minor Adjustment to Oakbridge Minor Site Plan shall be placed on file with the St. Lucie County Planning and Development Services Director. F.
