HomeMy WebLinkAboutPDS-16-038 - LA Buona Vita Mobile Home Park1\ PDS ORDER 16-038 2 FILE NO.: SPMN 620165031 3 4 AN ORDER OF THE PLANNING AND DEVELOPMENT SERVICES 5 DIRECTOR GRANTING A MINOR ADJUSTMENT TO THE LA 6 BUONA VITA MOBILE HOME PARK MAJOR SITE PLAN 7 8 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 9 request for a Minor Adjustment to the Major Site Plan for La Buona Vita Mobile Home Park and 10 reviewed the comments of the Development Review Committee and has made the following 11 determinations: 12 13 1. La Buona Vita Co-op, Inc. property owners requested a MinorAdjustment to the Major Site 14 Plan to allow an existing asphalt tennis court to be converted to sixteen (16) parking 15 spaces including two (2) ADA accessible spaces. Additional proposed improvements 16 include removal and modification of existing fencing, a paved ingress/egress drive, a 17 sidewalk to the clubhouse, landscaping and lighting. 18 19 2. March 3, 1981, the Board of County Commissioners approved a rezoning from B-3 20 (arterial business) to RMH-5 (mobile home park and subdivision) consisting of a 45 acre 21 tract located on the west side of US Hwy #1. The subject property was granted site plan 22 approval to be known as La Buona Vita Mobile Home Park. 23 24 3. The Development Review Committee has reviewed the MinorAdjustment to the proposed 25 project pursuant to the Land Development Code (LDC), Section 11.02.04 and found it to 26 meet technical requirements and to be consistent with the general purpose, goals, 27 objectives, and standards of the St. Lucie County Comprehensive Plan. Planning staff has 28 performed a detailed analysis of the project and found it to be consistent with the St. Lucie 29 County Land Development Code and Comprehensive Plan. The analysis is found in the 30 Planning and Development Services memorandum titled La Buona Vita MinorAdjustment 31 to Major Site Plan, dated August 8, 2016. 32 33 4. The project will not have an undue adverse effect on adjacent property, the character of 34 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the 35 public health, safety, and general welfare. 36 37 5. All reasonable steps have been taken to minimize any adverse effect of the proposed 38 project on the immediate surroundings through building design, site design, landscaping 39 and screening. 40 41 NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. 42 Lucie County, Florida: 43 44 A. Pursuant to Section 11.02.04(C) of the St. Lucie County Land Development Code, this 45 MinorAdjustment is hereby approved as shown on the drawing prepared by C. Calvert 46 Montgomery & Associates, Inc., dated July 13, 2016 and date stamped by the Planning & 47 Development Services Department on July 21, 2016 for the property described in 48 Paragraph B below, subject to the following conditions: , 49 JOSEPH E. The La Buona Vita Co-op, Inc. property owners is advised as part of this MinorAdjustment approval for La Buona Vita Mobile Home Park including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state, federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this MinorAdjustment to La Buona Vita Mobile Home Park Major Site Plan shall be placed on file with the St. Lucie County Planning and Development Services Director. F. This order shall be recorded in the Public Records of St. Lucie County. ORDER effective the 8th day of August, 2016.
