HomeMy WebLinkAboutPDS-16-037 - 2905 Rogers Road, Fort Pierce, FL.PDS NO. 16-037 2 File No. LS 720165041 3 4 AN ORDER APPROVING LOT SPLIT FOR PROPERTY CONSISTING OF 5 4.06 ACRES LOCATED AT 2905 ROGERS ROAD, FORT PIERCE, FL. 6 7 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 8 application for an Lot Split submitted by Steven Messer, Esq: on behalf of James Smith, Jr., 9 Trustee, and made the following findings: 10 11 1. The Lot Split application submitted on behalf of James Smith, Jr., Trustee has been 12 approved for parent parcel consisting of 4.06 acres of property zoned RS- 3 (Residential, 13 Single Family, 3 du/ 1 ac) zoning district, located on the west side of Rogers Road and 14 legally described as follows: 15 16 THE N'/ OF THE SW % OF THE SE % OF THE SE 1/ OF SECTION 19, TOWNSHIP 35 17 SOUTH, RANGE 40 EAST, IN LUCIE COUNTY, FLORIDA. (OR Book 2162, Page 18 1953). LESS AND EXCEPT THAT PORTION DESCRIBED IN OR BOOK 746, PAGE 19 1792, DEEDED TO LARRY SMITH. 20 21 PARCEL ID: 2419-443-0001-000/0 22 23 2. The division of the parent tract creates two lots depicted on the Boundary Survey created 24 by Charles Arnold, PLS dated September 14, 2016. The two lots are further described on 25 the boundary survey as proposed "parent tract" and "new parcel". 26 27 3. The Development Review Committee has reviewed the lot split on the subject property 28 and found it to meet technical requirements of the Code and the standards of review in 29 Section 11.03.04.D of the St. Lucie County Land Development Code as conditioned 30 herein, and to be consistent with the St. Lucie County Comprehensive Plan. 31 32 4. Staff has provided an analysis of the parcel's eligibility for a one-time split pursuant to 33 Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found 34 in a project summary and memorandum dated October 12, 2016 entitled James Smith , 35 Jr. Lot Split, File No. LS 720165041. 36 37 5. Section 11.03.04.F of the Land Development Code provides that no further division is 38 permitted unless a final record plat is prepared and submitted in accordance with the 39 Code. 40 41 NOW, THEREFORE, BE IT ORDERED: 42 43 A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the James 44 Smith, Jr. Lot Split is hereby approved as shown on the boundary survey prepared by 45 Charles Arnold, PLS dated September 14, 2016 by the Planning and Development 46 Services Director, subject to the following conditions: 47 48 1. Prior to issuance of a Vegetation Removal Permit or Exemption, and/or Building 49 Permit, the recorded warranty deeds reflecting final divisionof the property describing C JOSEPH E. Within 90 days after the recording of the PDS Order 16-037, the applicant shall submit 5 and execute all documents necessary to convey the required road right of way for 6 Rogers Road. Manner and form of conveyance shall be acceptable to the County 7 Attorney. The sketch and legal description shall be prepared by a Florida licensed 8 surveyor. Pursuant to Section 7.05.03 of the LDC, the applicant may be granted 9 credits against road impact fees. 10 11 B. A copy of this Order shall be attached to the boundary survey described in hereinabove, 12 and shall be placed on file in the Planning and Development Services Department. 13 14 C.
