4 AN ORDER APPROVING AN AFTER -THE -FACT LOT SPLIT FOR
5 PROPERTY CONSISTING OF 28.35 ACRES LOCATED AT 5545
6 KOBELGARD ROAD

8 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
9 application for an after -the -fact Lot Split submitted by James Johnson and Premier Citrus
10 Management and made the following findings:

12 1. The Lot Split application has been approved for property consisting of 28.35 acres of
13 property zoned AG -1 (Agricultural - 1 du/ac) and located approximately % mile north of
14 Indrio Road and 3/ mile east of 1-95 on Kobelgard Road and legally described as follows:

18 2. The division of the subject property creates two lots depicted on the Boundary Survey(s)
19 created by Frank Cuccurese, PSM, dated October 24, 2016. The two lots are further
20 described on the boundary survey as proposed parcel "A", and proposed parcel "B". Lot
21 "A" has a property address of 5545 Kobgard Road, and has a building permit pending �-
22 for a single family home. Lot B is vacan

24 3. The Development Review Committee has reviewed the lot split on the subject property
25 and found it to meet technical requirements of the Code and the standards of review in
26 Section 11.03.04.D of the St. Lucie County Land Development Code and to be consistent
27 with the St. Lucie County Comprehensive Pan.

29 4. Staff has provided an analysis of the parcel's eligibility for a one-time split pursuant to
30 Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found
31 in a project summary and memorandum dated November 18, 2016 entitled James
32 Johnson Lot Split, File No. LS 1020165076

35 NOW, THEREFORE, BE IT ORDERED:

37 A. Pursuant to Section 11. 03.04 of the St. Lucie County Land Development Code, the James
38 Turner Lot Split is hereby approved after the fact as shown on the boundary survey
39 prepared by Frank Cuccurese, PSM dated October 24, 2016 by the Planning and
40 Development Services Director, subject to the following conditions:

42 No further division of the property is permitted unless a final record plat is submitted in
43 accordance with the Code.

45 B. St. Lucie County is not responsible for the maintenance, upkeep or improvement of any
46 private drives, roads, streets, easements, or rights-of-way providing ingress and egress or
47 drainage service to the. subject property herein.

49 C. A copy of this Order shall be attached to the boundary survey described in hereinabove,
50 and shall be placed on file in the Planning and Development Services Department.
